China Likely to Alter Property Rights Law

BEIJING - China is changing its constitution to protect private property rights for the first time since the 1949 communist revolution ? a key step in making capitalism its economy's driving force.

A constitutional amendment endorsed by the Communist Party went before legislators on Monday and their approval seemed certain.

Party leaders who control the legislature already say private property is essential to advancing economic reforms that have let millions of Chinese lift themselves out of poverty.

Party leaders also sent the National People's Congress a proposed amendment to enshrine in the constitution the theories of former leader Jiang Zemin, who invited capitalists to join the party, the official Xinhua News Agency said.

Such changes would bring China's legal framework in line with its market-oriented reality. Entrepreneurs who play a critical role in creating jobs and wealth have been lobbying for the constitutional protection.

"The leadership has recognized that the private sector will be the major engine of (economic) growth in the coming years," said Joseph Cheng, a political scientist at City University of Hong Kong. "I think there's a strong consensus and this is largely uncontroversial."

The proposed amendment on property says "private property obtained legally shall not be violated," according to Xinhua. It said that would put private property "on an equal footing with public property."

The amendments were submitted to the Standing Committee of the NPC, a smaller, party-controlled body that handles lawmaking when the full legislature ? which only meets two weeks a year ? is out of session.

Despite a lack of constitutional protections so far, millions of Chinese have plunged ahead in starting businesses and buying homes and stock shares issued by state companies.

The proposed amendment on property is expected to lead to a series of legal changes that would make it easier to trade real estate and other private property.

"Individual Chinese citizens, at least the wealthy ones, now own property," Cheng said. "They want their property rights to be safe."

Yes, of course, but for them to go "Official" with private property in their constitution for the first time is a big, big deal.

The only downside China will undoubtly become extremely rich and even more powerful than they are already since this will draw enormous amounts of new capital investment and they have some of the cheapest labor in the world.

The US became powerful with manufacturing and now that's all going overseas for most industries and will continue to do so.

Our only salvation is the leadership role we have in technology and other advanced service industries.

Chinese are born capitalists. This latest move just formalizes a centuries old truth. Chinese are great businessmen. At least the ones from Fukien province. They OWN Southeast Asia. Also, Chinese OWN major parts of San Francisco (not Pacific Heights on the Marina but Richmond and major portions of the Sunset District)

The whole Maoist thing was more aberration than anything.

Not to mention finance and entertainment. The lower margin stuff is going overseas but the high margin stuff stays RIGHT HERE. Yeah, true capitalist, even the gang members are great at making money. They are great at smuggling people from China to all parts of the world. They make hundreds of millions a year doing it.

30K-40K per person, too bad they use dirty tactics to force people to pay the debt back as fast as possible.

That's true, most of the people that drive the nice cars where I live are Chinese. The Chinese can do pretty well if given freedom to do so, look at Hong Kong
