Shouldn't they still be held accountable when the person they outsource to fails to deliver?

Early this year, I posted on GFY looking for exclusive content providers. Some one from this board contacted me, saying his company could provide want I wanted for $800 per video. I ordered an initial 6 videos to test the waters. I paid the first half in advance. After several months delay, I received the first few videos and was asked for the second half of the payment for production of the rest of the videos to begin. Now, I should have broken the contract then and forgot about the other 3 videos since the first 3 were so late, but I feel it's important to honor contracts. So, I went ahead and paid for the next 3 videos. Months later, I received 2 of them. The third one, almost a year later, I have never received.

It turns out these videos were outsourced by the company that contacted me and that the person they outsourced them to disappered with a lot of their money, basically forcing them out of business. They seem to think the responsibility to reimburse me for the final video lies with ther person they outsourced the work to. I think it lies with the company that contacted me about the work in the first place.

What do you guys think?

I swear, I rarely have good experiences buying exclusive content. I have plenty of repeat business for you if you can just:

A. Deliver my content
B. Deliver my content on time
C. Deliver my content in the format I have paid for (If I pay for the originals, please send me the originals. If I pay extra for editing, actually edit the things.)
D. Provide me with the proper model docs

You were THEIR client, the fact that THEIR supplier screwed them over isnt your problem.

You paid for something so you should have it delivered

Rick,
you probably do next time a contract with a more professional company. That's the reason why we do not pay any longer in advance. If somebody will sell something, he/she should send it to us and we will review it. If it's ok, we will pay if not we will send the stuff back or to the trah can.

Ok, that's a little bit different to custom orders, but if the stuff is not ok, we will reduce the amount or get something extra next time. That will usually work and if not, we never do any bizz with this producer in the future, what will hurt them a little bit more

I get paid 100% upfront or I do not even make a call to a single model. Been burned a little in the past and won't EVER let that shit happen again.

Sorry you got screwed Rictor. To answer your question...Yes, the company who took your money is responsible. If they entrusted the work to another party and they fucked up....That is not your problem.

Yup, on company A. You had no deal with
company B, company A did. Company A owes you your cash back or a product that fits your criteria. Content sounds to be moot at this point, so they owe you the $$.

#1 - guy you contacted is responsible, he took the job.
#2 - if you want custom stuff be ready to pay through the nose if you want quality - unless this was like softcore pics, 800/scene is damn cheap.

You can really fuck them up if they are based in Southeast Asia. Hardcore porn production is against the law there (Viet, Thai, Phil, Singapore, Indo, Malay). Not a good idea to outsource there. Try Japan.

somebody who runs Asian movie sites told me that hardcore is illegal in Japan which is why you see the 'masked' Japanese AV movies with the genitals masked by pixel mosaic. The uncensored movies are illegal there.

This situation happened to me last week with Hardcore J ...

He sent me money for bizz cards . I knew a printer in tampa that could give me good reseller prices and he live near this place so I said why not . The guy looked reputable and everything ;)

Anyways shit happen, the order got lost from them and there was an error .

I refound Hardcore J AND he will get the cards .

People in adult dont know SHIT about customer service . If you cannot offer a service right, then payup for it .

And at LEAST give them what they deserve . Thats the LEAST you can do .

Anyways bottom of the line is that they should give you a full refound for your video + a partial refound for the time taken for the other videos .

You are being perfectly reasonable, with one possible exception. If you want a specific model, no exclusive content provider should guarantee a delivery date. Shit happens. She flakes out, gets a rash. Whatever.

I ask for a deposit from new clients equal to the model fees, payable by the day of the shoot. If the shoot does not happen, the deposit is returned, if desired.

When the shoot is complete, I am in a position to guarantee a delivery time.

Totally agree with you Aaron..although we do 50% deposit to cover our cost of production and the remaining 50% upon completion/delivery. They don't pay the remaining 50%, they don't get the content. We can always sell it, build a site, etc and recoup the costs.
And Rictor, I concur with Aaron on what he said, the company is responsible...at the very least, they should outsource the work to another compnay if they can't do it themselves.
