Microsoft could fight Acacia?

In Federal Court that is called a counter claim. The only major issue with that route is that you are counter suing Microsoft for defensive help from Acacia means that you are recognizing that Acacia's patent is valid and that Microsoft's software cause you to violate the patent.
We aren't at that stage. Acacia is against the ropes. There is no real reason to admit Acacia's patent is valid. It isn't. I would highly recommend suing Acacia in small claims court for unfair business practises. This will cause Acacia to waste need resources and usually only cost $22 to file.

Think about it this way...
Acacia had a decision to make after they started to receive funds from the mainstream mom + pop businesses. This decision was as follows. 1) Go after the likes of AOL / Microsoft. 2) Go after the (what they saw as) 'Seedy' Adult Industry. Choice one could have potentially given them a LOT of major grief if they went for the throats of AOL / Microsoft as, they would have most likely been taken to court and lost a LOT of money. Choice two, which they chose, they were hoping that because we work in the adult industry we would fold and not pull together as we have done, ultimately, it would have been a wiser business move on their part to go for AOL / Microsoft. AOL / Microsoft in all likelyhood would have negotiated a settlement deal, it would have taken a while but they would have settled. They chose adult. If they had even done any 'prior' research on the adult industry they would have seen how we stick together when something threatens our livelyhoods. It happened a few years ago by all accounts when some company thought they had a valid patent on e-commerce transactions, needless to say, that company is no longer around ![]() |
