She has given me permission in the past to use her stuff.

But - I am not sure yet.

What I'm contemplating is using Acacia's website streaming content - their own stuff - to challenge them.

Yep, flash animations are included too. .Gif won't be covered because it's not VOD.

No, infringement of a process utility patent is decided on whether a set of actions "reads on" (definition given here: http://www.ipcreators.org/General/gloss.htm#readon) the claims. Since the only difference is sophistication of compression, a GIF could as easily be read on the claims of Acacia's patent(s) as a SWF file.
