What I'm contemplating is using Acacia's website streaming content - their own stuff - to challenge them.

Yep, flash animations are included too. .Gif won't be covered because it's not VOD.

Since the only difference is sophistication of compression, a GIF could as easily be read on the claims of Acacia's patent(s) as a SWF file.
