Are Acacia taking a beating.

Found this on another board.

The company, according to the report, posted sales of $220,000 and a loss of $7-million"

The report said "future growth of the company depends on its ability to enforce 13-year old patents" which the company president admitted presents a "risk" to the company if the patents are challenged and invalidated.

Plus to make it even worse for them I think with my brothers help I may have found the "Prior Art" that will sink their ship.

Alan my youngest brother recently retired from Reuters, where he helped write the original program (his name is on their patent) did a search and found an article listing all the instances of prior art.

It was written by some one who claims he was employed as a principal scientist by one the pioneers of internet content delivery.

Sent it to www.impai.org for them to consider.

So, a bunch of lawyers sitting on a $30m+ pile of cash, seen this one before, do they necessarily care if they win or not, all they have to do is keep on running the show and keeping on putting that cash into their personal pockets as wages / fees. Who are the major shareholders?

Not necessarily good news for the minnows they like to play with.

That poor scientist from InterVU probably wishes he never wrote that back in January because of all the people that have contacted him about his 17 page document! Unfortunately, most of his references are from 1992, considerably past the time of the intitial filing of he Acacia patent(s).

Encourage your brother to keep searching though, charly. The more we have looking, the more likely we'll come up with something...

But the http://www.fighthepatent.com/Teleportation.html is a strange twist, are they looking forward to standing up in court and explaining this?

But this is not the way the "Patent" business works. You do not want to go to court and risk losing, you want to extort money from small guys and never have to justify it in a court of law. Or at least get £25 mil before you get to court and Sony stop the gravy train.

The article is satirical in making the interpretation of Acacia claiming patent on Teleportation. Inbetween the humor lies these points:


1) patents are sometimes written very broadly and slip by the USPTO

2) patents can be interpreted by the patent holder to mean whatever they think it means

3) patent holders sue companies to try and enforce their interpretations

4) patents can be invalidated by finding prior art, and by explaining to the judge and jury that the patent is not feasible, or possible.


While Acacia really doesn't claim teleportation (atlease I hope they don't), the article does show actual language that they used, that could allow you to interpret that they claim teleporation.

It's the same kind of language that they are interpretting to think they own the downloading/streaming of audio/video files from a (web) server.

Another satirical piece is about USA Video, another company that websites should be concerned about since they are suing MovieLink for the downloading of videos. (SightSound should also be mentioned here as well for similar claims).

The first Star Trek episode (not counting the pilot) aired on Sept 8, 1966 at 8:30pm on NBC, title was "The Man Trap" (according to a Trekkie site)

Gene Roddenberry was a genius and anyone who is familiar with him and his work would know.

Star Trek may have been a SCI Fi show but NASA and Physicists were always on board to make sure things were at least scientifically correct.

Everything in Star Trek is <i>theoretically</i> possible.

The problem is, since Star Trek merely suggests 'Teleportation' and doesnt give any tangible existence to the technology involved in making it reality, they hold no patent.

You can sit around thinking up ideas all day long, if you dont do anything with them, they arent worth anything.

This is why patents have to have diagrams showing how exactly things work.

You could draw a teleportation device, but no one would have a clue how to draw one that would actually work ;)

An idea is just an idea until it becomes tangible, thenm it becomes something.

Star Trek is nothing more than a histoical recount of man. Its all taken from history books pretty much. With a twist and some sci fi help, things change and the new story is born, but its basically about ship sailing and new lands ;)

Most people dont even see it or understand it. Its very similar to how cmuch Joseph Campbell (Power Of Mythology) had to do with Lucas doing Star Wars and Raiders Of The Lost Ark,(both are packed with religious and historical references)
