The problem I find is the government is trying to pressure me to sign the settlement package by making it look attractive. If I cooperate and sign it, they won't charge interest, they'll waive penalties, and they'll even knock off a percentage point from the GST amount due. If I fight it, they'll become more aggressive and remove all those kickbacks.

Regardless, I've consulted with a tax lawyer and the law is a gray area for internet sales, but because I'm entirely commission based, I should not have to pay the 7%. If I had a paysite, things would be different though.

In all honesty it would be easy to take the offer and say fuck it...mind you you still have to shell out the dough which sucks.
Knowing them in a year or two they will come back with something else that youforgot to pay or something.

Might set some precedent but it may cost an arm to do it too..

What I'm more worried about is if I sign it, that means I agree that I should have paid taxes and every signup from now on I must pay the 7% on. I know the sponsors won't pay an extra 7% so that means I just lost 7% of my bottom line and that's something I can't really afford to given the market conditions.

So unfortunately, I more or less have to fight it to ensure I don't lose that profit margin. My lawyer has the confidence we can win it, but it won't be cheap.

Not that clear. ..

Let's say you would get to invoice your sponsor from the US with a look like:

22 signups at 20.00 : 420.00

Total due: $ 420.00

In this case, since he is out of the country, you have no GST tp charge and none to remit.

If on the other hand you declare that YOU generated the commission, then they say it happened in Canada and they will say that the taxes are included, so to be remitted.


Paysites ( what I own) are fucked, so now my paysite is a US corp billing in the US. I pay expenses and a salary from US corp...
Accountants are taking care of that.

PS: don't forget, after the federal gov, you will have a vist from the provincial one.

Ideally, I am selling joins from my traffic to US companies. So I am performing a service for these US companies and should be exempt from collecting GST. What this auditor is trying to pull is that the SEO pages that I create was a service created in Canada and all attributed signups were generated from that service which was made in Canada. It's a grey area but I still think I'm right in not having to collect GST since the transactions that occur are made between surfers and sponsors, I am only involved in the redirection process.
