Most cam sites will state this as a no-no.... even blinds open and shit like that. Let me find the verbiage but I wouldn't toy with it. Especially if it's a US based site.

Our reasoning for not allowing affiliates to serve images and videos that are not hotlinked; is that there are times a model leaves and asks if we would remove the model's images for privacy reasons . We generally would as we understand that models may get married or wish to try and undo their adult webcam work for a mainstream job etc. . The copyright issues are moot as the model no longer is working for us and making us money.

The problem is that affiliates get threating letters from lawyers and boy-friends over the images that they use that are non-official and NOT hotlinked from our servers.

That is the policy and its reasoning at XloveCam. Other cam sites may view this differently but generally the use of non-official model images or video is frowned upon and even prohibited by Affiliate contracts.

MyFreeCams have a few camgirls that play outside but they are usually in the backyards. There are also a few that flash in public places like a library. I'm pretty sure that those are not actual places or very active because they could get busted for indecent exposure.

A passer-by on camera might cause some legal concerns but as long as the passer-by's exposure was unintended I don't see him having any legal remedy.

I thought he meant outside of the images available to affiliate -- we get asked that often.

The same reasoning would apply to any agreement you make though.

Models are non-exclusive contractors in most cases. The only termination offense is making side deals with our customers circumventing their agreements with us.

Problem is not outdoor but recognisable people there. Cam site needs ID of everyone appearing in the video, even an hand only for a second. No need you can recognise the face or person is clothed - even a bare hand or feet it SHOULD be 18+ and so need to have the ID to demonstrate it, or someone could say an underage was around even you seen only the hand or feet.
Other than this, if the person is recognisable, and he ends up in a screen capture in xhamsters or xvideos next to porn, and he got good lawyers, he could sue the cam site for trillion dollars.

If there is no other person on the video feed then you can shoot where ever you want provided all other terms are adhered to. Like committing a crime while doing a show might be against their TOS. So flashing in the public place might be bad. But if you are in the backyard or in any other place where you have a reasonable expectation of privacy then you are good.

Technically, a fenced in yard or out in the woods, in a place where only the model(s) would be on cam would be OK. In a public place, with nudity or explicit sex -- NO.

from what I understand the new rules don't completely put the kibosh on outdoor shows. the new rules:

a) disallow broadcasting "from a public place or from a studio or set that creates the impression that the performer is in a public place"

b) disallow "broadcasting outdoors unless the broadcast is done from private property, with the property owner?s consent, and in an area that is not visible from any neighboring property"

I dunno, to me the new rules kinda makes sense? Public spaces are difficult to control, and with live cam feeds if an unwitting individual walks into cam view it's too late, they're already being broadcast live on a porn site without their consent. In your example of peeps in the background too far away to be recognized, how is a chica focusing on her chat room gonna make sure no one comes close enough to have their face visible on cam?

I imagine the rule against studios made to look like public property is to prevent people from breaking the rules (it's not like cam site reps are there to inspect whether the space is actually a studio)

tldr; chicas can still broadcast outdoors, it just can't be an 'open' private property or a public property and people who haven't consented to being broadcast shouldn't be broadcast.

I work with the agent of one of the most famous "show in library" models in MFC and that's not rented, that's real public place and (most) people around are random who know nothing - just she got several bro people in the library to check who comes and who does what, she's not alone they're a team. It happened that a random guy in the library had MFC open in laptop, probably recognised library in a previous show, then went there to try meet the girl, I can't tell how it ended but basically she claimed drama and had him pay her nice tip as apology with promise he will never enter the library.
Also you can see very often girls driving or walking in large public parks (even in Japan - no idea what the laws there) which can not be rented absolutely, and with so many people there they can't be all your friends.
