A passer-by on camera might cause some legal concerns but as long as the passer-by's exposure was unintended I don't see him having any legal remedy.

I thought he meant outside of the images available to affiliate -- we get asked that often.

The same reasoning would apply to any agreement you make though.

Models are non-exclusive contractors in most cases. The only termination offense is making side deals with our customers circumventing their agreements with us.
