"Claiming self defense, a Black man shoots a mentally disabled Hispanic man who was walking his dog. Now, the Police are saying more about a shooting at a Taco Bell on April 3, 2012 in which left one man dead.

They're identifying the Hispanic male victim as 29-year-old Daniel Adkins. His family says Adkins is mentally disabled and has a mental capacity of a 12 year old child.

About 7:30 p.m., a 22-year-old Black man and his girlfriend ordered food at the Taco Bell drive-thru and were told to pull up while their order was prepared.

At the same time, Adkins walking his dog on a leash, stepped around a corner into the path and was almost hit by the driver 's vehicle.

Angry words were exchanged between he and the driver.

Exact details of the altercation is unclear but Adkins was shot once by the driver. He died at the scene.

The driver called police but has not been arrested.

At first, the couple claimed that Adkins had a metal pipe that he swung at them -- but it turns out he was holding a dog leash with his yellow lab on the other end.

Family members want that driver arrested, but he's claiming self-defense.

"He needs to be behind bars. I'll never see my brother again," says sister Marina Reyes. "If he felt that my brother was threatening him, he could have easily just rolled up the window and called the cops."

A metal pipe or bat was never located. An independent witness did say Adkins swung his fists in the driver's direction.

"He swung his fist towards the driver window, and at some point the driver shot him," says Phoenix Police Sgt. Tommy Thompson. "Just because we don't book a person immediately does not mean we don't charge a person at a later date."

The dog, Lady, stayed by Adkins' side until the Humane Society came. Adkins lived with his mom and dad. He's 29, but his family says he's mentally disabled and has the mental capacity of a 12-year-old. He didn't drive, and walked wherever he went.

"This person is still on the loose and I don't agree with that. So he's saying self defense, then where's the weapon? Where's the pipe? They didn't find anything on my brother," says Reyes. "He was just too aggressive, you don't need to go that far."

The shooter's name has not been released. The investigation is still ongoing."

The details of this case are in the pipe.

Did he swing a pipe or not?

I seriously doubt I would shoot for a swinging fist.
I seriously think I would shoot if he swung a pipe.

So that's in dispute. Two different stories about what was swung.

If the police can accurately dispute that a pipe was swung then I think they will probably file a charge.

This case had witnesses that saw the incident from start to finish, unlike Zimbo's case.
That does make a difference.

I wasn't aware of the Daniel Adkins case, and while it has not received the same national media attention that the Trayvon Martin case, I see it has been covered by most major media.

Additionally, groups like Change.org (which was active in pushing for a trial in the Martin case), actively supported action on the Adkins case.

I also noted that the shooter, Cordell Lamar Jude was in fact indicted for Adkins murder:

"The mere claim that you were engaged in self defense is not enough. There is a reasonable person standard that has to be reviewed in light of all the facts of the case as to whether or not someone would believe they needed to use deadly physical force to stop another person," said Montgomery.

Jude was served with the indictment Friday morning, and will be arraigned on August 9.

Two weeks ago, Jude was arrested for marijuana possession and having a gun in his car. Police say two guys in his car had just committed a drive-by and Jude was giving them a ride. He told police he had just met the guys.

Jude also told police he didn't know marijuana was illegal. Now that Jude is facing a second degree murder charge, the Adkins' family just hopes he shows up for court.

"I forgave him for what he did. It's hard for a father to do but if I hate somebody I'm just as bad as he is," said Daniel Adkins, Sr. "I feel a little bit of relief that at least the wheels of justice are starting."

Montgomery said he did not believe the shooting was racially-motivated.

Family members said that Adkins was mentally disabled and had the mental capacity of a 12-year-old.

The person killed was neither in a wheel chair, nor white.

So, my thoughts are this: if two facts as obvious as those cannot be agreed upon after watching a 2 minute video, it's no wonder that people can say anything and eventually it will be taken as fact.

Yes, I screwed up on the wheelchair part, I apologized for that, and it would have been irrelevent anyway, since there was no wheelchair in the Zimmerman case.

He was not indicted until 4 MONTHS LATER. Publicity about the Zimmerman case went crazy after 2 weeks and he was indicted within 6 weeks after the incident.

If the media was being consistent, then there would have been outcry within a couple of weeks.... in this case, there was none and it took 4 months for indictment.

That's a tragic story, but I don't see how colour comes into it. A bully/thug shot a disabled man who wasn't a threat. That alone should warrant jail time. If they were any other range of colours, the crime would be the same.

An independent witness did say Adkins swung his fists in the driver's direction. "He swung his fist towards the driver window, and at some point the driver shot him," says Phoenix Police Sgt.
