An Act of God
Last weekends snow storm that hit the East Coast not only killed half of my apartments power for 4 days, but a large tree branch fell on my 2000 Toyota Corolla and fucked it up. I called my insurance company and told them what happened, and mentioned it happened at the complex I live in. I told them I want my co-ops insurance to pay for this. She tells me to get an estimate. So I bring it to the body shop for an estimate and the guy says it's totaled. Since the body/roof damage will exceed the value of the car 3k.
I call and forward photos to the management company, then he gives me the number to the insurance companies broker. The broker tells me he will give me the direct number to the insurance company but also tells me that you don't have a case since it was "An Act of God" so I am like WTF my wife is from Japan and they don't believe in God. So he gives me the direct number to some lady named Megan. I called Megan and she basically told me "it was an Act of God" and sorry the complex is not responsible for something they did not cause. Tell your wife it's mother natures fault. ![]() Should I consult my lawyer or is this some loophole that insurance companies get away with? My other option is to put a claim in with my auto insurance company since I still have full coverage on the car. I would think if I do this my insurance will go up? |

If you check really close, you'll probably find your auto insurance doesn't cover acts of god either.

Talk to your own insurance. They will then deal with your co-ops insurance company.
Most likely both yours and the co-ops insurance will go up but its worth a shot.

sounds like the co-op's insurance coverage is spotty so they may be off the hook. If you have full coverage on the car yourself you should be ok though.

An Act of God would be the car vanishing in a Tornado or a Hurricane. A Tree that was not properly trimmed back for safety in storms in that particular area that hit every year is NOT an act of god its an act of poor management and safety on the part of the complex.
Some times its just in how you state the case.

I agree there MAY be some liability on the part of the co-op for not properly maintaining the tree, but the cool thing about full coverage is that you can let your insurance company deal with theirs. I'd just call your insurance company and tell them what happened, being sure to give them the name of the co-ops insurance. The two insurance companies will figure out who has to pay.

Its called COMPREHENSIVE insurance coverage - check it out: http://allinsuranceinfo.org/auto/com...-coverage.html There is no such thing as "Act of God" as long as you have comprehensive, thats why its there. Otherwise all those people who were a victim of floods, earthquakes, hail, etc. would be fucked. You should look online for an insurance adjuster first. never try and deal with scum bag insurance companies yourself, they are all trash. Your insurance company doesnt want to have to pay for it because they are cheap assholes, thats the honest truth. I'm guessing you have an agent that you called right? He/she said "no" because they want their office claims to be low, thats why. Dont let them dick you around!
