It sucks but it's not illegal or anything.

Just because people make TGPs, and submit them to thehun, doesn't mean you can say "I'm the only person that can link to these TGPs". Someone could go out tomorrow and build a website that is simply a list of TGPs that are posted on thehun.

Isn't that the whole reason behind forcing people to link to thehun on their TGP submission, so no matter if it get's linked or submitted somewhere else, there is a link to thehun plastered right there at the top of the page?

To adres your last comment first: we dont require a link back to thehun. Second, our database is copyright protected. Third, this goes further than stealing just the links. All our handmade descriptions are on that site as well. Building a site out of our links is illegal and has been taken to court succesfully in the past.

You might have your database copyright protected, but that doesn't make it illegal for someone else to create a list of TGP pages that your site links to. A database as a whole with it's specific information architecture and structure is something that can be copyrighted, a list of public information cannot be copyrighted.

There is no such thing as stealing links. A web page exists on it's own, anyone and everyone can link to it if they choose. No one "owns" the sole right to link to something. Someone can't make a html page and say "Tim over there is the only person allowed to link to this page, no one else is allowed to". That's not how it works.

You might have something with the handmade descriptions, but even that is questionable - If I search my sites in google, google displays text/titles/descriptions from my sites.

Incorrect... it is illegal to take information from ANY database and reproduce it without permission from the maker of the database. Especially since these people not only user our descriptions (to which we simply have the intellectual properties since we wrote them), but the links in our database are selected from a lot of links. They're not random links. And this site is using the properties of that list and reproduces it on his own site. Which is simply illegal without our permission.

the lawsuit we won was exactly the same scenario, someone copying links from our site and reusing them for his own site. We were the first to win such a lawsuit. Legislation came from our lawsuit against that person. And we won. Successfully in this case meant he had to remove the links and pay our damage and the lawsuit we filed against him. To point #1. Not entirely, just because you have information stored in a database does not mean you "own" that information - you own the database (not necessarily the specific information in it). You know what I mean? For example, Amazon.com has a list of all the books written by Stephen King (which is stored in their database), that does not mean they own the RIGHTS to lists of books written by Stephen King. If I go make a website that lists all the books written by Stephen King, Amazon.com can't sue me because they have that information in their database. Because they don't "own" that information simply because they have that information in their database.

To point #2 - I might be missing something here then, because I thought the site we were discussing was a search engine?

Ok... So you're saying. If I go out right now, and build a webpage that is a list of 20 links to sites I like, various sites all over the world (that I don't own).

Then I OWN the rights to that list of 20 sites, and I can sue anyone who creates a list of those 20 sites for copyright infringement?

Right? That's basically what you are saying.

Even better, what if I have a database of one link to google from ages ago (before google was even made let's say). Are you saying I can go sue everyone who has ever linked to google because they are copying or "duplicating" my database?

It's like music. There are notes and chords (links) that can be used freely by anyone. But create a certain combination of notes and chords, called a song (database) and another person is not allowed to use the chords and notes of that song in the same order...

making a song = creating. Copying a song = stealing...

So your saying. If I go create a web page of one hundred links (to various sites I just happen to like). Then I OWN that combination of links, and anyone who ever creates a list of those 100 websites is in violation of my copyright?

A simple yes or no would suffice by the way.





One last question though. Does it work if it's only a list of 5 sites, or does it have to be a higher number like a hundred?

So if I make a site that lists the following five websites.

? skidoorentals.com

You're saying I "CREATED" the list, therefore own it, and anyone who puts the same list on their website would be in violation of copyright?

I don't get it, the first link for me when I type TheHun Anal Mp4 is this one:

Which would be the same link that the eve site would serve. Are you going to sue Google for offering a link that was made specifically for you guys? If you don't like it get a robots file to block that site from yours. You can't get mad at people when their crawler hits your page, crawls it like hundreds of others, yet their design/SEO trumps yours so their sites are higher.

Not my site but if it was I would tell you to go cry to someone else and would be happy to go to court and show that a crawler, just like Google's crawler, simply does a search and finds links and points people to those links.
