This is why it's illegal to videotape a police officer.

They don't want evidence to exist that will be used against them in court.

Funny though, how it's completely legal for them to videotape you for the purpose of conviction...

Actually it is not trespassing. Just b/c the guy does not live there the cop had no warranted reason to believe he was trespassing. If it was his friends house he had reason to be there, and if the owner of the home does not complain about trespassing there is no trespassing crime. The guy was fully within his rights to be both filming and standing where he was. Sadly this stuff happens a lot, you would think with all the videos of it something would be done on a major scale but people rather ignore it.

It is not illegal to film a police officer, it is not illegal to film anyone when you are in public or on private property such as this guy was. How do you think the poperatzy get away with basically stalking?

an officer here in phoenix put a crack pipe on a lady here. the camera at the crime lab filmed him doing it. his punishment one day and he was paid. he said that he was just playing with her. wanna see? http://www.azfamily.com/video/featur...105005254.html

Yep I remember that. I had a buddy get arrested by Mesa Police, they put a meth pipe on him sadly no camera's caught it and he was prosecuted. Funny thing was the guy doesn't drink or smoke anything and was going to collage, needless to say he wasted a lot of money on a degree he really can't use b/c of a drug charge.

Sad but true. In the UK they already made it illegal to videotape police activity. It's part of some new anti-terrorism measures. Officially it is to prevent terrorist from identifying and targeting police officers. In reality they only use it if someone catches them beating up and tasing people.

I'm not sure about US law but in Canadian law you can resist an illegal arrest without penalty.

As to the people saying when he said he didn't live there he was trespassing, not necessarily so, he could have been on the property with permission.

That said a police officer isn't allowed to detain you because he thinks you might be trespassing, the officer needs evidence or needs some probable cause before he or she can arrest you or even detain you.

The police can't go up to someone and ask them if they live where they're standing and when they say no just automatically take them to the ground as if they are trespassing. That would be chaos.

i believe you are mistaken. its perfectly legal to video tape cops. they will often give you a hard time but if you know your shit, they know they don't have a leg to stand on. they don't like people knowing this though and will often try to strong arm you from taping but its totally in your legal right to do so.

So if you were on the jury you must have voted to convict then right? Why would you do that if you thought the charges were a bad joke?

i believe you are mistaken. its perfectly legal to video tape cops. they will often give you a hard time but if you know your shit, they know they don't have a leg to stand on. they don't like people knowing this though and will often try to strong arm you from taping but its totally in your legal right to do so.
A Chicago court recently ruled in favor of the police with a videographer beat down, claiming that videotaping the police officer interfered with his job duties.

There was another case recently where the judge said something to the effect of "I don't want our police to have to second-guess their job function. That's why we're convicting people who videotape the police."

I'm not saying I agree with it... I'm just letting you know what the courts are backing these days. It's fucked up!

Honestly...the courts are backing up the cops 99.99% of the time. They are all buddies. Just go to traffic court one day and you quickly realize that judges, attorneys, and cops are all on a first name basis and socialize together as well. They are all on the same "team".

That's how cops get away with killing people all the time and get a slap on the wrist.

Yeah... my brother's a public defender. He's talked many times about their legal social circle. I guess it kinda makes sense... since they all work together.

But I'll be damned if I'm not going to have a video tape to back myself up when it comes to interfacing with the police.

Did you see the photos of that accident I witnessed a few months back involving the CHP motorcycle cop and a Prius? Well get this... the 2 pages of my witness testimony where I said the cop was traveling a minimum of 70 mph in a 35 zone... pages were torn out of the report.

They manipulate information all day long. They see that as being their job.

I have a brother and two cousins who are cops. And my mom was a deputy sheriff for 30 years. You better believe they all work together with the courts and manipulate things.

bottom line is your not going to win an arguement with the cops... you may win in court but not on the street with the cop... he deserved the beating he got for trying to act like a baddass....
He could have been standing in the driveway of his moms house, his GFs house, his buddies house, or anyone else he knew.

The cop should have asked next, are you visiting someone here. THEN if he said no, ask to see his ID and go from there, doing nothing that involved violence.

However, the guy should have been straight up in the first place. That *may* have ended it right there. Or maybe not.
