Class Action Suit: Archive Cash and Rehab Dollars

I know a lot of people are owed money by SOBV, and I was wondering how many webmasters want to get together and file a joint lawsuit. I've never had to do this before, so I don't really know how the process even works. Theses companies owe me a decent amount of money, and that aside, It's the way these companies are handling this situation that makes me want to do this. Realistically, I don't think we will ever get paid, but maybe this will be a thorn in their side.

If any of you have any experiences with this sort of thing, I'd love to hear any feedback. Also, if anyone knows an attorney that would work well with this, please let me know.

Unless you are owed a serious amount of money (and I don't mean $1000) it probably won't be worth it. Even if there is a judgment in your favor and their assets could be located and seized (highly unlikely based on everything I've been reading about them), you'll end up with a very, very small percent of what you were owed. The attorney wins big, you end up with lunch money.

This is an unfortunate situation.

Depending on the TOS you could end up A LOT worse off than that. I've sen many TOS's that limit your dealings to " the program " or " the domain " of the program and additionally limit any suit to a pre-defined amount. Some go so far as to say you are "entitled" to nothing or they can change the payout's at any time etc etc etc ...

Went down this road before ( in mainstream ) and seriously wish I had not.

Do you think the potential payout is in the millions? How deep are the pockets of the defendant? Is there a common set of facts or is each tort peculiar to each plaintiff?

Just asking some basic questions. Litigation isn't cheap.

Not basic.... vital to a class being certified. Depending on the jurisdiction, it is sometimes impossible to get a class certified by the court based on what $5 Submission stated... is there a common set of facts or is each tort peculiar to each plaintiff ?

And its actually a detailed analysis the court goes through to determine the answer to this basic question.

Perhaps part of it for some is just to send a message to other sponsors that affiliates will not silently roll over if you screw them. I'd think even for some if all they could do is seize their domain names this would bring a lot of satisfaction.

tos isn't the same as a legal agreement. if they added , "by signing up you agree to sell us your house for $1 and to recieve 100% of your income for life "

they couldn't just take your house and all your paychecks for the rest of your life.

every amusement park in america has a tos that reads something like " we cannot be held responsible for injury etc etc " , yet loads of them have been sued and were eventually held responsible for an injury
