Went down this road before ( in mainstream ) and seriously wish I had not.

tos isn't the same as a legal agreement. if they added , "by signing up you agree to sell us your house for $1 and to recieve 100% of your income for life "
they couldn't just take your house and all your paychecks for the rest of your life.
every amusement park in america has a tos that reads something like " we cannot be held responsible for injury etc etc " , yet loads of them have been sued and were eventually held responsible for an injury
