All they did was delay things ... looks like the ICANN board wants to negotiate w/ GAC. This does NOT mean that .XXX is beaten, so don't celebrate yet. This is just a procedural delay.

of course they did. they have to wait for it to go before the GAC again. the GAC will deny him again for not having the sponsored communities backing. this guy is ruthless though. he won't stop. even when he's denied, he will start over.

stuart is banking on everyone in adult now thinking that he's been defeated so he can pull some shit under the guise of darkness. its like in the movies when you watch a street fight and you think that the guy is knocked out conscious and you turn you back on him and he gets up and smacks you with a pipe and KOs you.

i'd hope no one falls for this. it's not over.

The FSC board elections are coming up again... I know Jeffrey is safe, but still, everyone make sure to vote for Jeffrey and for Reed Lee. I was on the board, and I promise you, they are the FSC's greatest assets other than Diane of course.

I have a question for FSC.

What do you intend to do now that ICANN is determined to approve .XXX and the only thing holding them up is that little thing called support from the sponsored community, and the blessing of the GAC?

This whole thing wreaks of a movie plot at this point. It's apparent that Lawley has obviously gotten to ICANN and now I would assume the next move from him is to "make a friend" inside GAC somehow, or potentially have his ICANN ally now try to lobby the GAC in his favor financially and or politically somehow. Everyone likes money.

How does the FSC intend to thwart the attempts of ICM to get to the GAC and corrupt the process that is apparently not working in his favor this whole time?

It's brutally obvious by the comments during the commenting periods opened by ICANN that he does not have the support of the industry, and that all early registrations were accomplished by opportunists, domaineers, and scared .com TLD holders. The GAC saw right through it the first time.

Who's going to get bought off this time around? What can the FSC do to help thwart this, or at least be able to blow the whistle on some corruption?

This whole thing is stinking like a dead corpse at this point.

FYI, thanks for fighting the fight so far. This has been going on for over 5 years now.

Thanks.

I hope the FSC will continue to monitor the .XXX gTLD's progress (or lack of progress) and offer input and express concerns when and where appropriate.

Actually, it's an sTLD... and that's a big part of the problem. ;-)

yeah looks like another typical post on here where people fudge the title on purpose for views. Declines to approve XXX sounds pretty final, but if all they did was "postpone" a decision then that isn't anything great, the shit is still out there and not over with yet.

This is killing me. Why do people keep posting these "good news" comments, when all that happened was a delay. I hope that it get defeated, but NOTHING was decided, and in fact ICANN used language saying they intend to enter into an agreement for .XXX with ICM.

People, NOTHING DEFINITIVE has happened yet. if ICANN can get the GAC to drop its objections, then it's over and .XXX will happen. So the only thing that I can see standing in the way is the fact that there's no measurable industry support.

DO NOT DROP YOUR GUARD.

because of the miss leading title. Very few people actually read around here. They see the title say " ICAAN Declines to Approve .XXX" and it sounds like it is over. Miss leading title + stupid people = the answer you looking for.

Two significantly different quotes from different parties:

Quote:
“It would have been an unwise decision to disregard GAC’s resolute opposition, potentially having grave impact on ICANN’s multi-community model. The sponsorship community is opposed, and ICANN’s Government Advisory Committee is opposed. The only entity that would have benefited from an immediate approval was ICM.”
versus

Quote:
According to ICM's Stuart Lawley, today's decision was what he had hoped for.

"As per their bylaws, when they decide to do something that is or may not be in accordance with GAC advice, they must confer with the GAC and their statement today that they intend to sign the contract with us, has officially triggered that process that will be complete in February," Lawley said.
Hard to follow unless you are privy to the politics behind all this which most of us are not. Which is more telling the truth here minus the spin? Can they really go ahead and do it if the ICANN G.A.C. is against it?

Porn sites closer to getting '.xxx' Web address

(AP) – 2 hours ago

WASHINGTON (AP) — The Internet's key oversight body is one step closer to giving pornography websites their own online address.

The Internet Corporation for Assigned Names and Numbers, or ICANN, voted Friday to move ahead on a contract with an American company, which plans to sell domain names ending in a new ".xxx" suffix.

The vote to enter into an agreement with ICM Registry LLC came at an ICANN meeting in Cartagena, Colombia. ICANN voted in June to proceed with the contract — reversing several decisions to reject ICM's application.

The new registry still has other hurdles to clear, however. ICANN also voted Friday to consult on the matter with an advisory committee comprised of government officials worldwide. The committee has raised concerns about a suffix dedicated solely to sites with adult content.

So What Exactly Did ICANN Decide About .XXX and New TLDs Today?
Friday, December 10th, 2010

Issues mostly punted to next year.

There’s an old truism amongst lawyers. Show them a one page contract and they’ll tell you it’s rock solid. Show them a long contract and they can start poking holes in it.

That truism carries over to ICANN’s resolutions on .xxx and new top level domain names today. They’re long and therefore say less than usual. There’s a lot of wiggle room.

.XXX - ICANN “intends” to enter into a contract with ICM Registry to run .xxx. Yesterday I predicted it would be full steam ahead on .xxx, but I was wrong. This looks like a slow crawl to the finish line. Mark my words — if .xxx doesn’t get resolved before the Draft Applicant Guidebook, ICM will lay down the legal hammer on ICANN. And that could delay new TLDs.

Quote:
More time is needed to work through some remaining issues, the board of the Internet Corporation for Assigned Names and Numbers board said in a resolution approved at a meeting in Cartagena, Colombia, on Friday.

Specifically, ICANN wants to give its Governmental Advisory Committee (GAC) a chance to weigh in on key issues such as trademark protection, malicious conduct, root-zone scaling, economic impact, geographic names and morality-based objections. The ICANN board expects to meet with the GAC in February of next year.

However, finalization of this mechanism, known formally at the Applicant Guidebook, is now closer than ever, said Peter Dengate Thrush, ICANN board chairman. "I think we have reached a turning point in relation to that program and hopefully the resolution captures that," he said during the board meeting, which was webcast.

"There are some intense and difficult problems ahead of us, but the number of them have shrunk dramatically from when we started this," he added.

I do find some encouragement in the fact that Lawley has gone from calling the idea of referring the question back to GAC "unnecessary" (prior to today's meeting) to saying that referring it back to the GAC is what he "hoped for" (after the meeting).

If doublespeak were an Olympic event, Lawley would have more gold medals to hang around his neck than does Michael Phelps.

If .XXX is eventually approved, I will be very, very interested to see how ICM/IFFOR go about making good on statements like:

Quote:
For consumers who wish to browse adult entertainment sites, [.XXX] will provide reassurance that they are protected from risk around identity theft, credit card fraud and child abuse images.
So.... no UGC content sites allowed, I presume? I further assume that in order to provide this "reassurance" about such things, IFFOR will be proactively auditing the 2257 records of .XXX domain-holders? And they must be planning to do some measure of credit card transaction risk management that is greater than that currently offered by Paycom, CCBill and other IPSPs? Awesome!

Those things mentioned above must be part of the plan, right? Otherwise, how could they provide any greater assurance that surfers will be "protected" than the current environment offers?

The real answer is, of course, they can't reasonably offer the assurances that they have promised..... Period.

Or maybe they have their own billing companies picked out, websites that use .XXX will be required to use one of their "approved" billing companies?

What exactly would stop me from setting up a .XXX, processing a bunch of fraudulent charges, and then even if they cut me off... coming up with a new identity and starting all over?

And why would ANYONE from the adult industry support .XXX where there are all kinds of things that could go wrong, all kinds of ways they could lose customers and/or control over their own business, and pretty much no measurable upside to being on a .XXX domain? The good news is, I know of like 2 people who have voiced public support of .XXX, both seems to be in the game with ICM, and that does NOT make up a community by any means ... so I'd expect that G.A.C. might still have some concerns about whether the requirements have REALLY been met. Let's hope.
