well, that pissed me off! norman is not the police or the fbi - it's not his job to provide proof in court or anywhere else. it's not his job to determine how strong the proof is. he runs a content company. the district attorney does investigations. the d.a. couldn't run a content company and norman has no business finding or weighing evidence. simple.

as a result, if something was stolen from norman - even if there's a question of it - he should call the law. and if any one of us had a similar situation, i would apply that to them.

At least one webmaster (probably more) has offered to sign an affidavit swearing the list belongs to Matrix.

That's enough proof to file a court action against Acacia to make them stop using the list.

The real proof is that Matrix refuses to do anything. Why?

It is their responsibility to protect their customers, not the other way around.

Matrix is not trying to fix the problem.

I have wondered about that too Sly... how and better yet WHY some of these 'interviews' are sooo nicey nice when the subject is this touchy. Xanex? Valium? lol I rarely get upset but in a situation like that you would hear a tad bit of "wanna rip your throat out" if it were me talking to them.

CE got an injunction because some guy posted on a message board that he had a copy of their mailing list. If a semi anonymous message board post is enough to get an injunction, then signed affidavits should be more than enough.

Why would Acacia object to an injunction unless they really are using a Matrix list?

If I recall correctly he said "proof" that will hold up in court...and further stated that only a few even bothered to call him to discuss what they think is proof...let alone present proof that will hold up in court.

Why are they demanding 100% proof? Such a thing is fictitious, and comes across as a ploy of the desparate.

"The Burden of Proof" in any civil litigation is a preponderance of evidence - aka more likely than not, or 51%.

From the evidence seen here (many misspellings, unique company names, etc.), it could easily be established that the Matrix list was used in civil court.

yea know I was trying to back off them... but this is BS.. I called them.. they told me they would call me back and still have not... yet no one that has called has any proof.

At the time I recived the Acacia letter, I currently owned about 50 domains, 97% of them were at the same registar as the name in question.. 3 domains are on 2 other registars. I called Acaca and found out they only have one domain name on file that I owen. Which is allso the only name listed in my store account info at Matrix.

The only place I have ever used the domain in question is at Matrix content. The domain has never been a website sence I've owned it and it's never been used anywhere other than Matrix. Acacia did not find that name through any program or even a web search.. There is no way being the site is a 404, it has no content nadda thing.

Now let's say Acacia's little college kids were searching day and night, looking for the evil doers. Why would they have this one name on their list, when It's never been a website? Is a 404 error violating their patent?

I then called Matrix they told me, that Acacia told them , they got lists of domains from the registars with certian adult keywords. This is allso not a possible reason for Acacia to have my name. It just so happens the day I registered the domain in question, may 9th. I allso registered a second domain with the exact same keyword in it (sex). On the 13th of May I bought 2 more domains with adult keywords one with (porn) and one with (Sex).

Now within 4 days I registered 4 domains with adult keywords 3 with the same keyword in question.. If Acacia got my information from the registar by using adult keywords, wouldn't it be safe to assume they would have the other 3 domains. Let alone the 50 other domains that I'd say 70% of them have adult keywords.

In my mind this all adds up.. yea I'm sure you could say the tooth fairy gave it to them but I'd highly doubt it. Just to make my self feel better I logged into evey single program I've ever signed up with, including content companys.. I checked domain info at them all. The only place with that domain is Matrix, and it is the only domain Matrix has. This agin is allso the only domain Acacia has.

I personally belive this is enough proof, to show my info came from Matrix, now I'm still not claiming they handed it over to Acacia but I can say my info did come from their online store database. It allso did not come from a processer being I never bought anything from Matrix only signed up to view their online store.

When you add my proof with the what several others claim they have... even if everyone else's is not rock solid.. the bulk adds up to one thing IMO.

I would like to know how they can claim no one has called them with any proof when I have... My phone call with Matrix was cut short due to their lawyer calling, I was told they would call me back... I was never called back.
