THEN BOOM!!!!!! THEY ARE IN YOUR 'AVS' PROTECTED SITE, VIEWING ALL THE SHIT YOU GOT IN THERE;

AND THE SAME TYPE OF CONTENT YOU OFFER ON YOUR SITE, BE IT SOFT PORN OR XXXXXXXXXXXX RATED, IS STILL FREE ANYWHERE AND EVERYWHERE ONLINE, ANY MINOR CAN GET THERE HANDS ON IT IF THEY WANT TO.

I don't think too many webmasters are using AVS to protect adult content from kids anymore dude..

great! less competition for the rest of us :thumbsup seriously, did you really think AVS protected anything? there are tons more hardcore in TGPs and link lists... AVS is really just a "front" and a way for webmasters to make more money because they know the surfer has a credit card. what we should be worried about is that the goverment will crack down and we will need another form of verification. i believe in some countries like germany, EVERY adult site must be behind an AVS. this would make an AVS pretty useless if what you say about everyone being able to get a cash card is true. :2 cents:

There was a debate like this when Adult Check and the other first AVS systems started up.

I was one of the first to start taking checks online for site access.
It was a tad primitive back then. We were doing it all internally and processing and printing checks with just electronic authorization and I got one of my banks to accept the printed check deposits without signatures. Can't imagine how I manged that one, but I did. LOL, Anyway, this was pre ACH via the net days obviously.

A few people were saying I was violating the requirement for proof of age by credit card law, but my point was checking accounts required you to be over 18 also. And also any kid could go online with their parents card and use it too.

Legally you have to be 18 to enter into a binding contract. So if a kid buys a prepaid mastercard and uses it. I don't think merchants will sell one to them. And secondly you wouldn't have a legally binding transaction anyway.

There's a lot of reasons for using an AVS - one of which being to keep the hardcore away from the kids. But there's also screening the surfer to see if he is a wallet-puller, and covering your ass should anyone in a black suit show up at your door.

Putting a textbox with a "by entering this site you agree that..." statement doesn't keep people from entering free sites either, but it *does* present a legal defense if you're ever taken to court. Putting that textbox there is literally creating a contract, you're giving the surfer a limited license to view your content which is null and void if they break the contract (such as by being underage or by being somewhere where viewing porn online is illegal).

Even if it may not keep all of the kids out, it's still a good idea and a good reason to do it. This is just a slow, experimentary migration from paper/coin currency to purely electronic currency. We'll have a lot of things like this popping up and fading away over the next few years until we're finally rid of paper/coin currency (maybe by 2010?). Just roll with it... and even if it doesn't present much of a challenge to the kids, keep doing whatever you can to cover your ass.

Sure it is, it's just more about screening for members that have credit cards (and are willing to use them) than screening out minors.

The whole idea of a valid credit card creating a rebuttable presumption of age was part of the Helms amendment to COPA.

Since the courts decided that COPA was unconstitutional I don't think that has applied for quite some time now.

But AVS has been and continues to be a very good business model.

Since COPA is still mired in the courts a credit card is still a safe harbor and still a good model until the law either is voided or amended.

If that's the case, then why would these underage kids just use their cards to join AVS?

There is no contract, and you can't enter into contracts with underage people anyways. So even if it was a contract, any minors are not bound to it.

KNOW WHAT THE FUCK YOU ARE TALKING ABOUT BEFORE MAKING A COMPLETE TIT OF YOURSELF ON THE BOARDS.

From what I have understood reading about these cards is that the money is loaded ONTO them from a valid credit card.

Not sure what the point is that this guy is trying to make. The user of one of these cards will have to get the money onto them from somewhere.



Another point is... we might know that the avs system is not entirely pure at heart with wanting to charge a fee to access the porn "to keep the net clean for kids" I mean we tell surfers that but we tell them alot of shit.

Infact all porn behind an avs system would keep it cleaner but we would have to clean up our tours and censor etc..

Lets let the politicians think we are atleast trying to keep the net porn free for the kids.
