What did you buy?

A design?

I hear all this talk about copyright's and stuff.

Well as of this morning you may have paid amp for the design, but it has been registered under copyright laws by my copyright attorney this morning.

All this talk about copyright's and shit, i really doubt any of you ever legally registered anything. In fact im willing to bet none of you even have attorney's or can afford one.

If you can and do, please send me a copy of the LEGAL Copyright showing a date previous to this morning.

Becasue as far as I know, I now LEGALLY own the design dispite who created it, owned it or bought it.

the thing is amp offered his work to bucknaked who gave it to hungryman. it's not as if he issued an invoice for it. and given it was an "in-joke" and a non-issue for so long it would be easy to prove that it's hungry's.. Amp consented to it's use. irrespective of sides and all that.. i don't think objectively he would lose the right to it in court.

Why would you buy a design that has so many problems attached to it?

And to be 100% honest that design kinda sucks, even amp mentioned he wasn't to fond of it. You should have paid money to have a new site built and avoid all this.

I offered to pay what is owed to take over the design because I could use it and help out one I respect...

I don't like ANY lawyers.. :) my last one fleeced 1k from me in addition to his fee in a very-hard-to-get-back way on a government rebate on buying a house.

Interesting. I suppose if someone copyrighted this material already legally since yesterday, you paid the initial $30 for registration of a claim to copyright. Then you paid the $580 for special claim to expedite the registration of your qualified claim, assuming your claim was qualified. I think there is a waiting period for approval of a claim as well, which would provide an opposing party the opportunity to file their claim too. So I doubt any claim filed yesterday is legally valid today.

I hate to intrude in such a stimulating argument over copyright laws, but according to the US Copyright Office:

"Your work is under copyright protection the moment it is created and fixed in a tangible form so that it is perceptible either directly or with the aid of a machine or device."

So the moment the design was created, it was indeed copyrighted.

Therefor, the only reason one would file it legally, is to have a record of it's existance. The original PSD files by the material's creator are proof enough, and never really need to be filed in order for them to be legally copyrighted to the creator.

Copyright is automatic. As soon as an artist creates something, he has copyright. While trademarks are often registered, copyrights definitely don't need to be. Boneprone, you need to find some new jokes. The current material is getting old.

It's too late now. You want it to be recorded as sealed in the envelope at the earliest recorded date. Like BEFORE shit like this pop's off.

But yeah, a lot of writers use the poor mans copyright before they send their newly completed works off to people for review/consideration.


If its still unclear here....

You would put your completed works in a fedex envelope & ship it to yourself. Then you have the earliest record of the completed works.

That's absolutely correct. The only reason to ever file a copyright through the government is so that you have a record of it on file to prevent yourself from ever having to go to court in the first place, and also preventing someone from wasting their money filing a copyright claim on something they have absolutely no rights to.

Bone, if you really filed a claim yesterday, it's invalid, and you just wasted your $3500 or whatever it was you paid.

But how would you prove you are the original artist of a web design?

I for one wouldn't purchase a design without psd's and originals of all images/clipart used.

Whoever holds the PSD's could techinically argue that they are the original design. You could try to show other examples of work to prove that it LOOKS like the same type of design.

But if that was worth anything, there would be a lot of bands that could sue each other for sounding like one another.

They could say that the music that sounds like them was acutally originally created by them (if they had the original tracks as well - like in this case with mutiple people having PSDs)
