I don't like a lot of the law suites you guys have done or the practice of legal threat against smaller webmasters in a lot of your cases. IMO you guys act as a bully trying to scare the little guy into giving in because you have a lot of money. (mainly in your trademark cases)

However, I'd give you my full support in this kind of case, because I think you are on the right track. Bravo for using your legal power for the right thing and focusing on the right direction.

They were the first one to do the Adult dating thing right, one of the first to offer geo ip solutions to affiliates, they allow customization of their ads with your own pictures....and they are an established brand that alot of people recognize.

those are just some of the reason.

plus they are extremely lenient and don't police their affiliates much and don't enforce their TOS unless asked to. fucked up really

I think that point has been discussed on here to naseaum and nothing much has happened, hopefully this will be the start of some positive action on their part

just fyi- XPays has a history of protecting our legal rights and yes we have issued c&d's and dmca's (more than i count off the top of my head); But, XPays has filed one UDRP against XXXPays.com (which we won) and 1 Copyright Lawsuit (still in progress). 1 udrp and 1 lawsuit - that's all.

you say we have a lot of money - the reality is we should a lot more. if infringers did not infringe.....

That "affiliate" is a pre-paid spot guaranteed. Not an "affiliate" like you would traditionally think of who is earning a percentage of sales. That is a pre-paid, upfront deal that was brokered with full knowledge.
