it's true unless you are going to use Charly's content where special rules apply.

NightCaster 08-15-2002 10:01 AM

Does anyone have a website where the case is described?

gothweb 08-15-2002 10:02 AM

Just because it isn't illegal doesn't mean you should do it.

kosmic 08-15-2002 10:03 AM

Thumbnail Theft, WTF! Thats just not right.

jesus christ, in a pragmatic sense, who the fuck cares?

does someone have a link to an article?

gothweb 08-15-2002 10:09 AM

Pragmatic huh?

I just mean that just because shot dirtbag got away with theft and set a precident that it is legal doesn't make it okay.

montel 08-15-2002 10:12 AM

check out google's image search... they have millions of copyright images thumbnailed.

What about using thumbnails of images from sponsor hosted galleries on your own TGP? You don't own the copyright for that thumbnail but you are linking to the sponsor gallery...

quite a few i would imagine...

Anyway I think the legal term is 'fair use'. Have seen some links on it but dont remember where...

lucky482 08-16-2002 02:35 PM

Correct me if im wrong but wouldn't thumbnails be considered banners? Which most content license allow use of their content as banners, which allows the banners to be hosted on any domain as long as it links back to the site that holds the license.

So why would anyone think thumbnails are illegal..

Most sites use them for blind links...

Notice the fools who fight for fair use dont own any copyrights to anything.

If you did, you wouldnt hide behind such minute details.

I take plenty of pics, and everyone of them I post has my URL on it, for a reason, I dont trust one fuck when it comes to my own images.

Just think if all the pics of my herbs I post, some fools were collecting them and making a site about them and popping "Piss test" pills on the pages, thats cool right?

Fuck no.

I mean afterall, its just a pic of marijuana I found in google right?

No, someone took it. me.

My pics are my pics, dont use em.

Fuck fair use.

I see people arguing all the time they don't want their pictures thumbnailed (mostly non adult) and even people that DO NOT WANT search engines visiting their pages.

You should see all the bitching on some of the google boards about google caching their pages and the image search. I have made thousands of dollars off of googlke image search and cache traffic.

Sometimes people shoot themselves in the foot. Thumbnails in these types of cases almost always indirectly help the photographer and their clients.

Copyright is a legal protection to encourage artists - it is not an absolute license for all eternity.

if there is precedent i would like to know, and so would any thumbnail preview tgp webmaster as we host thumbnails submitted to us by apparent licensed users, but technically the thumbnails preside on our server..

The ones on my servers yes. Unless I own a license to them.

If I *link* a picture here, that cannot be compared to someone *gathering* someone elses images.

The REASON I link them is so I dont put them on my server and host them myself, which would be theft.

Valid point.

I can just imagine the reactions on their face when they look through their logs...
