Stupid Models

So I shoot a model on Friday the 15th and told her I'd give her a couple images from the shoot since she didn't have any high quality photos. She emails me today saying she wants a copy of everything we shot and tries to tell me I can't use her images or video until I give her what she's (thinks) entitled to. She signed the model release that stated she has no rights to anything being shot and was of course paid.

I emailed her back and told her since she was being demanding and trying to tell me what I can and can't do with the content that she wouldn't get anything. She writes back telling me she's entitled to what we shot and if I didn't send her copies of everything she would sue me. Stupid new models, it was her first shoot by the way.

Obviously she didn't read the paperwork that she signed. I was trying to be nice by offering her some images from the shoot but she tries to pull this crap on me...

Anyone else ever had that happen to them?

Juilan 12-20-2006 11:12 PM

Yes, it can escalate to comical proportions.

Does she have a copy of the contract she signed?

auscguy 12-20-2006 11:18 PM

Get a few photoshopped, add on a few pounds to her...then send her those images

Even is she does, what are the chances she comprehends what she reads

Relax, dude, shit happens. Every day we deal with stupidity, don't make it a problem. Do what's suggested above.

No she didn't get a copy of the contract. She also tried to tell me that I was breaching the contract because I didn't give her a copy. So she thinks I have no right to use the content... :1orglaugh

phasic 12-21-2006 12:52 AM

Insomniac, im interested in some content. ICQ me. Lets do biz.

starpimps 12-21-2006 12:58 AM

models are there to sit pretty
tell her to read the release

After Shock Media 12-21-2006 01:05 AM

Honestly you should provide people with a copy of contracts they sign. No reason not to unless you desire to be an ass.

As for providing some copies. Not to damn hard to provide a copy of the photographs and just watermark them. No reason to have even one additional person bad mouthing you, or getting all pissed off and then having some meth head they know rob your equipment.

cutievids 12-21-2006 01:06 AM

hey, that would make some good marketing "regretful sluts" :)

HostGladiator 12-21-2006 01:43 AM

Someone requested an add via ICQ and put in gfy, biz. Not sure who it was and I accepted the add but stupid trillian didn't let me add you back. So, hit me up whoever it was and let's do some biz. :thumbsup

Next time insist the model reads it. Ask her "did you read it?" and maybe have a witness just in case. :thumbsup

You are pretty unprofessional. Give her what she wants and make her happy so she will work together with you again.

It's not a big effort to burn a CD with her images and your copyright notice on it. I would also give her prints of the best 10 or 20 shots. That's little effort and cost on your side.

Most professional shooters will supply their models with a CD and some prints.

I don't think most professional shooters would provide a CD, some prints and a modeling fee unless it was discussed and agreed upon ahead of time :thumbsup

Which is why we have a 'witness' sign it as well. Which is normally another model.

That's why I asked, if your in the U.S. she needs to have her copy of the contract, and if she lost it then easy access to a copy.

That's a bit harsh.

As DeanCapture said, unless it was agreed beforehand, the model is entitled to nothing except a paycheck once the model release is signed. Shots from the shoot are the property of the photographer and it's up to his or her discretion whether he wants to give them to the model. Of course it's usually not a problem at all, we're usually more than happy to, but if someone gave me lip and tried to tell me what I could or could not do, that generosity would evaporate faster than her job prospects.

Personally, in this scenario I would do what auscguy recommends, Photoshop her, watermark the shit out of the shots, then send them with a compliment slip. :winkwink:

Don

well fucking said!

why been an ass? just email her a copy and tell her to stfu. where is the drama? you sound almost as new to it as she does. everyone has had a model or 5 do freaky shit.

Chris Corn 12-21-2006 08:18 AM

Thats an easy one. First if you didnt agree to give her pics, then just ignore her first and possibly second contact or demand asking for them. On her third try apologys and give her an empty promise. On the fourth try send her one or two pics via e-mail. Dont qualify her demands with legit responses it will only anger her, making her assert her position even more. The great majority of people do not understand logic and if pushed, push back. Dont push, just ignore. Especially if you didnt agree to it...if you did then send her the pics. End of story...what she gonna do anyway.

What ASM said is true but I don't think my clients want their contracts floating around with every model I shoot for them. I'm not even close to as new to this as she is but thanks anyways. She's not the first to try this crap on me either, it just annoys me so I thought I would vent.

I agree with you, Dean...the "coming back, and demanding crap", is bullshit! Especially after he said he'd send her a few - and then she demands the whole shoot, which she was PAID for?

And the post regarding "also give her prints of the best 10 or 20 shots.", I don't THINK so! Are you her lawyer?

Exactly, I don't know where people get that we should pay a model, make prints for her, and give her/them a CD of everything. Kinda defeats the purpose of paying them for the content.. Now if it where a TFP/CD then of course she'd get a copy of everything and I'd even photoshop a few pics for her but she wouldn't be getting paid.

I dont think ANY professional shooters will give a cd unless they paid for the rights to the images.
I know I wouldnt.
The CD i give are 800x600 with my watermark accross the middle and low res. They can tell me what ones they want and then I will get them printed.
Giving them the full res even with your watermark is stupid.
I only give the CD if they paid me.
If I paid them I will sometimes give a couple prints if she wants them for her bf or wall or something.

Also I always make sure the model has a copy of the contract/release.
