Filing chargeback against bankrupt business?
 
Just wonder if anyone has had a similar situation...

A few weeks back I bought furniture from a local place. Between the time I purchased it and the time it was supposed to be delivered they filed for bankruptcy. Now they're telling me that they wont give me my furniture, or even refund me and that if I want to see anything back I'll have to file a claim and "get in line with the other creditors".

Can i just call my CC company and file a dispute without any legal ramifications because of their bankruptcy status?

You can attempt to let the CC company handle it, wouldnt hurt.

However the bankrupty issue does fuck you and puts you in line with everyone else.

Oh when calling the CC company for dispute, I would not mention the bankruptcy part. Just go with falire to deliver etc.

Yes. It's easy to charge-back for services or product never delivered. Make your written request short and to the point. Don't even mention bankruptcy. Product ordered, not yet delivered, order cancled, charge-back requested.

Actually, I have a better answer for you:

Call your local police and charge the management with fraud.

If they were aware that bankrupcy was pending (ie, the company was already making the motions) then it is likely that they knew they would not be able to deliver your product as paid for, and as such, it is fraud. It is a question of intent.

something like this happened where I live a little while back. A big furniture company was operating as normal, on Saturday everything was cool. On Sunday the doors were locked. Nobody, not even the employees were told about it. there were a lot of people that had paid for stuff that never got delivered (or they were supposed to pick it up and then the store was closed) they declared bankruptcy and never opened back up. They screwed a lot of customers and employees.

The news here was saying if you paid them by check, cancel the check. if you paid by credit card then contact your bank to charge it back. I would start there and see what happens.

What he said, especially the part about not saying they're bankrupt.

If they come back to you and say that the company is bankrupt and that they can't pay, you can sue the credit card company in the small claims courts (because not only do you have a contract with the shop, you also have a contract with the credit card company).
