A lawsuit claimed that McCalla sent more than 280 million illegal spam e-mail messages. Frims advertised in the spam had already been ordered to cough up a billion dollars in damages.

Prosecutors argued that under state law in effect at the time, CIS was entitled to $10 per illegal e-mail.

The Iowa court was told the defendants "falsely and illegally" represented that their e-mails originated from the CIS domain The e-mails used the cis.net as a return address to disguise the source of the e-mails to avoid complaints.

CIS acknowledged that it is unlikely to see any of the judgement money but said that it was time that spammers learnt that their actions would result in an economic death penalty.

On the other hand, it's way too high! They want to cap medical jury awards, but a single spammer amounts to billions? I dont think thats as damaging as a botched operation or something that literally damages a person.

They will not see a dime. The judge that levied that amount should be disbarred. That is a slap in the face of the ant-spam people in that the judge issues some "cartoon amount" that he and everyone around him knows will never be paid.

Financial Death Penalty? Think about it... if you worked at a lending institution and some guy showed up for a loan and you saw that he had a judgment for 1/2 of the deficit of the state of California would you take it seriously or would you write it off as some kind of error?

An 11 billion dollar judgment is a joke no matter how you look at it.

not really .. the huge fine makes it impossible to pay , thus he will claim bankruptcy , and can start up again not owing anybody a dime.

It never fails to amaze me as to how the GFY financial and legal interpretations work.

Wages get garnished for things like child support and income taxes, not generally in civil suits, even with awards. I'm not saying it can't happen, just that it doesn't happen very often.

Judgements and liens don't mean too terribly much too, unless you are trying to either buy something on credit or sell real property, such as real estate. If you own property and there is a lien against you, it must be paid off before the title to the property can be transferred. Cars, boats, that sort of thing don't generally count in a lien situation either. Only real estate and the like. Once again, this is not an absolute rule, it's just how it generally is done.

Next, no spammer that I know would ever bother putting their own name on their shit anyway. That's what their moms, kids, etc are for...

All in all, I'd say the chances of the judgement ever being paid would be zero. Spammer just buys stuff in another country paying cash and lives happily ever after.
