Wondering that too. Judge Miller said that the ruling on the injuction would be "sooner rather than later" but that was months ago.

Sites are already getting raided. A Washington State BDSM site was shut down last week. I asked the webmaster to post here to tell us about it, but I guess she hasn't yet.

Sherm - it wasnt 2257 related - it was some WMs that got scared that the obscenity task force was going after BDSM sites and they voluntarily shut down themselves - at least according to their media release

2257 Agreement Extended Again - For One Month
 
Got this in from FSC.


Denver, Co. ? A motion was filed in the U.S. District Court of Colorado this afternoon that extends for one month the original stipulated agreement between the parties for a temporary restraining order (TRO) in Free Speech Coalition et al v. Alberto Gonzales.

The extension will terminate November 30, 2005, or until the Court rules on Plaintiffs? motion for preliminary injunction, whichever occurs first. During that time period, the Justice Department is restrained from inspecting or enforcing U.S.C. 18 § 2257 against plaintiffs in the case, which includes all members of the Free Speech Coalition.

Terms of the original stipulation are once more maintained intact, and it is still the expectation of the attorneys for the Free Speech Coalition that a decision by U.S District Court Judge Walker D. Miller on the Plaintiff?s motion for a preliminary injunction will be rendered soon.

?We understand that the adult entertainment community is as eager as we are to have a ruling on our motion for a preliminary injunction,? said FSC Executive Director Michelle L. Freridge, ?but sometimes the wheels of justice revolve very slowly, and we simply must be patient. But make no mistake, we are as confident as ever that our arguments challenging these abusive regulations will win out at the end of the day. We appreciate your patience, and look forward to ultimate victory in this significant battle to protect your free speech rights.?

I heard a rumor on another board that the DOJ seemed to be giving in on some of the 2257 stuff that they had written in (like what is considered explicit). Is there any truth to that?

I haven't heard anything to that effect. I'm sure the attorneys for both sides would keep an agreement like that under wraps until all the details were finalized. Only afterwards, would they make a formal announcement.

Hey Redrob, when all is said and done with 2257...what is going to be done with the membership list that is the hands of some court appointed clerk.
Will it be turned over to the government so they can start with the names on the list?
I am just curious as to how this will be handled and just how secure the list will be once the new regulations are in place.

It is not a clerk, but a retired judge, who is keeping the master list under the terms of the stipulated agreement with the Feds. When that agreement is up, the list will be returned to us, but it will never be handed over to the government. Now, the actual ruling by the court on the motion for a preliminary injunction, which we are waiting for right now, will determine the reach of 2257, and what the government can do with respect to it while both sides prepare for the full trial. But please be assured that the list of FSC members will never be given to anyone for any reason other than one similar to this situation, where the full force of the law guarantees its secrecy.

Redrob, thanks for getting Tom to answer my question. It puts me at ease knowing we wont just be put on the chopping block by the government because we are part of an organization that stands up for the rights and freedoms of the people.
