Will Link Hotten Pics From Another Server Help With 2257?
 
I figure as long as you link hotten images from someone elses server you wont have to keep the records right?

Looks like the US webmasters might be turning to the way of the Chinese webmaster over the next few weeks :winkwink:

Lee, it isn't WHERE the content is, it is who causes it to be published. If the content appears to be on your site, no matter where the content ACTUALLY is, the DOJ will come and ask you to prove what you published is legal.

Same trick for live show plugins. If the URL of the live show is the same as the site calling it, then technically the site calling it is responsble for publishing the content.

It would be like playboy magazine being able ot publish CP because the pages were printed in another country.

I've read the regulations. Hotlinking an explicit pic on your damn domain will be considered illegal by any court in America. Go ahead and try it if you think it's going to help. Just don't give credibility to this morons claim because innocent bystanders might take his word as gospel and get themselves in trouble.

Professionally, these new 2257 regs dont affect us at all.

Our 'porn' business has and always will be run out of our UK offices with the exception of 1 site which will have its ownership transferred to our British company early next month.

I was mearly offering up an alternative point of view considering that in the past, the courts have weighed in favor of those who actually host the images / links in any given case as oppose to those who actually 'publish' the links / images.

Yeah that's the keyword, COURTS. You have to go to COURT first which means getting ARRESTED and then paying A LOT of money for a LAWYER.

People that have to comply( and I know you Euros think you don't so I'm not even getting into that. I'm talking about Americans here ) need to quit trying to be cutesy with the language of the regs and trying to find loopholes which may or may not exist and get busy complying. If there are loopholes or whatever let the LAWYERS find them. Until a court tells you that you don't have to comply I suggest you do.

The good thing is, its the people in the industry who are only doing this as a hobby that are trying to skirt around these new regs.

Anyone who has been running sites as a serious business will already realize that these new regs really arent as bad as others are making them out to be, i mean, didnt anyone keep proper records prior to these new regs being signed?

Its not rocket science people, if you were up to speed prior to these new regs being published, being up to speed on them on the 23rd June is no biggie at all, you have to add one additional peice of information to your data, thats all :2 cents:
