Not necessarily. At the criminal and civil level a jury could be very sympathetic to Simmons seeing as how this guy is larger than Simmons and was making derogatory comments and did not stop even when asked to.

On the civil level he wont be able to show actual damages, and the Simmons has a defense of consent to the battery. The guy in this case was basically asking for it by issuing fighting words to Simmons, or challenging Simmons in a manner that a reasonable man might take great offense to.

Of course trials cost money and he might get a nuisance settlement.

I would have slapped the shit out of the guy too. I'm not saying that Richard Simmons was right but he has helped alot of people improve the Quality of their lives. Why should he have to put up with some idiot making fun of what he does. I bet that guy he slapped doesn't near about have as much money as Richard Simmons.
