"If that site doesn't have audio/video but sends traffic to a sponsor site that does have streaming media, but no license, then that site needs a license from Acacia. If that sponsor signs up with Acacia later on, then the affiliate does not have to pay royalties on the revenues received from the Acacia-licensed sponsor. "

so anything than links to a site that links to video is in violation? Thats three degrees of sepearation and on the web thats basically everyone in this biz.....wtf?

m no lawyer but i know that if i link to a site that has a link to another site that has celeb photos (or something else "unauthorized") im not responsible for distribution and these are extremely clear cut laws....

how is this valid for patent infringement if its not valid under every other treatment of the law?

Google and Yahoo link to sites with streaming video.

Sue them. :1orglaugh

They have lost their mind already but now it seems the have no head at all... lawyers can try anything, but they know that there's no way to win this way. They're trying just scare & collect from small poor webmasters.

Fuck those cocksmokers. That part of their threat will never stand up in court.

chrisp420 10-29-2003 03:55 AM

seems pretty clear to me..

you host video/audio and have no licence = bad

you use a sponser who uses video = they need the licence

you just link to a sponser who uses video and no licence, and are being harrassed about infringment and told you need a licence to link to a non-licenced site = down right stupid

like many have said before, links make the web up, no links, no web.. borring. if you dont directly do video/audio streams, fuck it, the link claim dosent seem like it holds much water, if you do well thats up to you what to do..

this is what my understanding after weeding through post after post and interviews. just my :2 cents: mabey im wrong..

If non paysite owners don't need a license if there traffic goes to a sponsor with acacia license, then.. Is there some kind of list compiled of sponsors who are now licensed? I'm sure this would help a lot of us out.

This post is EXACTLY what this acacia deal is all about. Brilliant.

That article looks to be Acacia propaganda to me...

Here's why...

Supporting Sponsors Who Settle = MORE PATENT LAWSUITS! Others have patents too!

If the sponsors fighting Acacia give in, they'll regret it later...no I'm not talking because of us webmasters, but rather because Acacia is *NOT* THE ONLY COMPANY WITH METHOD PATENTS READY TO POUNCE!

Those sponsors which settled with Acacia, *and those webmasters who support them*, are under the mistaken belief that settling makes the problem disappear...nope, not exactly...other companies are ready to file patent infringement suits as well, if they see Acacia is sucessful.

Sponsors which haven't settled must be persistent and aggressively FIGHT BACK...for if sponsors, and webmasters too, give in now, they are doomed to a future of constantly fighting more patent infringement lawsuits on many fronts brought by numerous other parties...

Acacia needs to be stopped hard right now!

If sponsors and/or others are short on cash to fight the case, I'm sure a bunch of us can forego some sales and/or donate money to assist...

Hmm there is something in their License

http://www.afrochicks.com/info/acaci...s/image11.html

under the Point 4 Representations, Warranties and Covenants

In the event that Licensed User contests or assists others in contesting the validity of this Agreement, AMTC, upon writen notice to Licensed User, may immediatly terminate this.

So it seems to me that when you do sign that crap and you support any one who does fight them then you did pay for nothing.
