Brandon you strike me as knowledgeable about many "industry" issues.

I would like to hear your thoughts about "fair use" with regards to my magazine SexEducation.com.

First a little background ...
SexEducation.com has always been a magazine or "forum" of discussion where anyone can make contributions and "critique" responses etc etc ...

Then I got into a battle with LadyMischief and Fluid (aka: whatever handle of the day) ...

and they argued "well" and we "battled" and I claimed freedom of speech (a newbie yes) etc etc ..

Then LadyMischief posted some links to "fair use" and I read them - and I could see some for her issues ...

so I deleted all the graphics from the website until I could sort things out ... still haven't ...

I want the website to show how stupid I was in the beggining and my initial male sexual prejudices before I began studying up on issues ... it is from the "whole" of the website ... that the global standard of what everyone should know before having partner sex has emerged (the tour - the first 7 pages)
(shows expansion of human knowledge)


My questions are ...
A magazine that critiques the entire "sexual knowledge" of the internet can it quote ANY graphics ANYWHERE to explain whatever particular concept is being explained ? ...

And if I need a picture of a "vagina" lets say to label for anatomy, because basically any would do - can I use any under "fair use"?

OR

Can I only use "fair use" when the graphics is so rare it is doubtful I would find another within 5 years of searching?


So to reiterate my question ... can I use "fair use" when any old graphic would suffice OR only when the graphic is so rare - I wouldn't even know how or where to purchase it?

I found some on Vivid, on AMAContent, some pregnancy shots by JoviGirl, and some techniques stuff be Sobe, and others places ...

last night I bumped into PamPhage which has a couple graphics I need ....

First you have to qualify as a magazine etc and then even if you do... the photo owner can pop your butt for using their property withOUT their written consent.

I've never seen an educational video I have liked yet.

AEBN has a unique licensing agreement with their suppliers. As such their AUP of what they can do is limited by that unique relationship with their "content" suppliers.

In talking to my AEBN representative it was explained to - BECAUSE I ASKED - that their licensing arangement did not allow for affiliates to "screen capture" what the wanted REGARDLESS of whether the graphic of that screen capture LINKED DIRECTLY to the AEBN purchase of the viewing of that film.

I have informally requested AEBN (they are waiting on a response from me - for further action) to create a custom "sex education) cinema - and fully intend to promote their services in the future WITHOUT making some of the mistakes I have in the past - like I did with LegendaryLars.com and Hustler.com.

Images are copyright to the person or company that produced the picture.

Just because you find an image like on google's image search or on some website, doesn't mean you can just grab it and use..

You would be breaking copyright law in my opinion.

some images are able to be used as "fair use"...and if people sent you some links, read through to see if your situation qualifies, and most importantly consult with an attorney.

If you consider yourself a "magazine", even more reason to be checking with a copyright attorney. There is no "freedom of speech" with images in using someone else's copyrighted work.

I believe the "fair use" comes into play with public figures, using images in works of news/satire, etc..

While I am no attorney, i do and have an opinion much like everyone on here. If you wanted to seek it specifically, use email next time, rather than calling me out on a board and using my domain name to draw attention.

Those are all content providers that sell images. So just buy the images you need. If they aren't selling them by the image on their website, email them and ask if they will.

They don't even have to leave the site to get access to his lovely "adults only" site, that in fact doesn't have any kind of age verification.. Go through his "tour" and type in your age at the end.. in fact, put in 12, and see what happens :P
