any info on this is appreciated
id like to shoot content of non-nude women on boardwalks, street, whatever.
i did a quick search and see a nice bunch of tips on this and many point of views. i also see lensman (who im sure knows what he is talking about) say the following: Quote:

I belive it's legal, as far as using it for profit...I think there MAY be laws behind that to some extent.
ex: spring break, festivals, college partys I've done public non nude shots in the past, mostly around one of the major Shopping AVE in my area. However these shots were not done for profit, they were done mainly for a few laughs at the whoring sluts in my area. I did honor people who requested to be removed etc... |

The main concerns are (1.) using the images commercially, (2.) where the pictures were taken, (3.) how the images were obtained, (4.) how they are presented and (5.) whether or not the subject might have an vested right to their image.
(1.) Commercial use of the image means using it to advertise or promote something. You are allowed to exploit an image by selling it or including within a publication that is sold, but you can't use images of people to get others to buy something without a signed release. Keep in mind that without a model's release, you are dealing with a subject. (2.) The general rule is: If both you and the subject are on publicly accessable property, then you're in the clear. However, pictures taken in a night club that is recognizable within the shot may get you into trouble without a location release from the club. (3.) Images that are obtained by "extaordinary means", such as hidden cameras or telescopic lenses, may get you into trouble. Generally, if the camera was in full view of the subject and it was obvious that you were taking a picture, then the result is publishable. (4.) You cannot fictionalize or embellish the images in the publication. Images that are obtained this way are documentary in nature and can only be safely used as such. A model's release, among other things, usually states that the images can be fictionalized and, lacking that, you are required to either let the image speak for itself or be truthfull in your commentary. (5.) Prominent people, such as politicians, movie stars and sports figures, have a vested right to the use of their image since their career or income could be affected by it. This shouldn't be a concern unless you've decided to become a papparazi, in which case you'd best learn the nuances from a master first. |

Oh, and as a side note on this subject: The only time you can ever get into trouble with this is by a specific complaint from a person who is identifiable within the image. In other words, let's say you did a site of pics of lowriders that showed thong (this is an actual niche, btw!). If you tour just had waist views of "just about anyone", you would never have a problem. But, as soon as you included a distinctive lower back tatoo, you'd be placing yourself at (possible) risk.
