NEW YORK, Aug. 22 ? A federal judge on Friday denied Fox News Channel?s request for an injunction to block humorist Al Franken?s new book, whose title mocks the Fox slogan ?fair and balanced.?

U.S. DISTRICT JUDGE Denny Chin said Fox?s claim was ?wholly without merit, both factually and legally.?

The network had argued the subtitle to Franken?s book ?Lies and the Lying Liars Who Tell Them? could trick some consumers into believing the book is associated with Fox.

The book?s subtitle is ?A fair and balanced look at the Right.?

Fox trademarked ?fair and balanced? in 1998.

The book went on sale nationally Thursday, moved up from its September rollout date because of publicity from the lawsuit.

The publisher added 50,000 copies to the original run of 270,000 after the suit was filed.

The cover features Franken standing in front of a television monitor with screens of President Bush, Vice President Dick Cheney, conservative pundit Ann Coulter and Fox host Bill O?Reilly.

The word ?Lies,? in the title, appears in large print over the four screens.

The Fox lawsuit described Franken as a ?C-level political commentator? who is ?increasingly unfunny? and suggested he was ?intoxicated or deranged? when he confronted a table of Fox personalities at a correspondents? dinner in April.

Preliminary injunctions aren't easy to obtain in cases like this. You have to quickly prove that you would most likely succeed on the merits of the case, and then the judge balances the hardships on either side. Fox still may pursue a civil suit against that doofus Franken, if they choose.

Umm better read the article last I heard those are political figures in the pictures and the trademark term is as old as News reporting goes. In otherwords it is invalid.

CNN attacked Clinton constantly while he was president, a lot more than they have ever done to Bush.

"Parody is a form of artistic expression protected by the First Amendment. The keystone to parody is imitation. Mr. Franken is clearly mocking Fox," said Chin.

The judge said he thought it ironic that a media company that should be fighting to protect free speech would seek to undermine the First Amendment. He also said he thought the "fair and balanced" trademark is weak because the phrase is used so often.

As for the trademarked phrase itself, Chin said that it was "unlikely a valid trademark. ... The mark is a weak one as trademarks go."

During oral arguments, Chin brought up one of O'Reilly's books, "The Good, the Bad and the Completely Ridiculous in American Life" as an example of a similar play on a well-known phrase -- in this case, the title of a Clint Eastwood movie, "The Good, the Bad and the Ugly."

If all the liberal left has are Michael Moore and Al Franken then they really are hard up. Not that the right has any better representatives. Are there really no intellectual people who are liberal or conservative. I mean Shawn Hannity is no brain trust. Holy rollers who want you only to be able to watch the cartoon channel and liberals who want to redistribute all my income both scare me. What is Chris Mathews? He is really one of the few who seems to use his brain and isn't spewing some left or ideology. I guess i am a moderate.
