Board stealing content
 
A big portuguese board is posting stolen content from one of my paysites. I already asked the mods to take it down, what else can I do? Should I try to contact their host? Threaten them? What?..

Copyright is there, even if you don't register your content. Think it's $700 per image. Write them, you don't get satisfaction, write their ISP.

This is 100% bullshit.. The only time something is "public domain" is if a) it's produced by the government or b) the original artist or photographer abandons their copyright. Read the DMCA lately?

I read legal summaries. e.g., Lessig who actually knows IP law quite well and can put the legislation in context of precdent.

I contend that less than .01% of GFY users have read the DMCA cover to cover. Have you? Can you quote it?

If I img src them... I will be starting a war. And I dont need a war with a board that has 100+ leechers and some hackers connected at the same time, all the time.

I will try to find their host and talk to them, and I'll talk to their sponsor (I know him).

If all else fails, can I img src them in a way that they cant track it? And what kind of traffic would I need to take them down?

Of course this is not legal, and I am just curious about it :Graucho

OK just so everyone is shooting form the same place ? remains with the originator of the image for a minimum of 50 years ( i believe this has or will soon be extended to 75 years) it dose not have to be registered to be ? although its advisable. Each copyright infringement is punishable by a fine of up to $150,000 per infringement ( that is not per image ) So if you find 10 images being used on a website on one page that is 1 infringement.

Since 1995 we have successful sued and won 6 cases of copyright thief both on and off the internet but its a long costly affair. You should go after the ISP if you get no joy from the webmaster of the website. Put everything in writing and get a return receipt for each letter sent, good luck

Angelonfire there's no watermark on the pics, that doesnt mean there's no copyright.

That's good for the States... International Copyright is different and very hard to enforce... Unless you have big bucks... :2 cents:

I fucking HATE Rackshack. The whole company is poorly run, poorly operated, and offers poor service. I would LOVE to see you slam them with a DMCA suit. I might even consider offering you one of my lawyers to hook that up if it's big enough.

You send them the DMCA and they have 24 hours to react. Do this over a weekend if possible. If they don't, then you pick a state and file in small claims court (or real court if you want). Pick your most convenient venue, and you include that they have minimum contacts wherever you are, and drag their asses to you. They may be more than willing to settle given the cost of fighting a case in your venue. Talk to a lawyer.

I am in Portugal, not in the US.

I am still waiting for an answer from them.
