Mark Kernes reports in AVN: "Draft" of rule requiring "barrier protection" in hardcore is floated "for discussion

LOS ANGELES—The California Division of Occupational Safety & Health's Senior Safety Engineer Deborah Gold today released what is described as "a draft provided solely for the purposes of facilitating discussion at the June 7, 2011 meeting" of the Cal/OSHA Subcommittee on Control Measures—but if this is actually the starting point for the discussion, the adult movie and internet industry is already in deep trouble.

I'm not trying to split hairs, but does "shall provide" simply mean "make available" at the employer's cost?

It could be interpreted that the employer has to provide the protection, but that the performer may at their own option, weigh their personal decision based upon the available info (test results, etc), and then decide for themselves to use or not use the available protection.

If so, then that is my current practice...no problem.

I really can't believe that they expect performers to wear gloves and goggles (eye protection) when doing scenes.

Taken to its extreme, that means no French kissing without a protective barrier, and no swapping spit... :ugone2far

Not worried. People like DWB and people in other states do it every day. Not worried. California have all of 2 people going set to set to enforce this. OSHA and the state of California do not have the money or recourses to enforce this.

And as for the fines to fund this? Everyone who got fined is fighting it. These court fights will take years. OSHA and California will go broke playing this game. Furthermore all shooters will quit pulling permits to shoot, giving California even less money.

Redrob seems to be good people and is no way a troll. I like what he writes and I like how he cares enough about our industry to inform us. I may disagree with Redrob from time to time, but I do have the utmost respect for him and his opinion.

not to get into a fight with you, but "this industry" is not an american only thing. there's actually multi-million companies outside the US who have not ever heard of FSC or AVA (actually i have never heard of AVA either).

I agree with this 100%. California is in no position to enforce this on a large scale, regardless if they make condoms mandatory or not. Yea, they may hit a few people just to prove a point, but in the grand scheme of things, California is DEAD BROKE and it's not getting any better. Having said that, it also wouldn't surprise me to see them spend money on something stupid like this.

Production with both go underground and move to other states. Simple solution really. Shoot it elsewhere and ship it your office in Van Nuys. Just don't use the US Postal Service to do it. :upsidedow

However, producers will really need to be careful who they work with. All it takes is some porn chick who the police turned because she was caught with meth, and you're raided at your secret location. Same applies to assistants, make-up artists, or any other staff you may have. If you go underground, security will become your number one priority if you want to stay in business.

Laws are quickly becoming meaningless in the USA. The laws vary between states, so you can talk on your cell phone in the car, but cross a state line & you get canned. Not to mention how laws outright contradict each other (weed)
