Judge: Tubes Cannot Profit from Users' Copyright Infringement

YNOT ? A U.S. District Court has awarded San Francisco, Calif.-based Titan Media more than $1.35 million in damages from a company owned by two German men. According to the judge?s ruling, Antelope Media LLC?s ?tube? site allowed users to infringe the gay adult studio?s intellectual property rights with impunity while Antelope profited from advertising and membership fees.

In order to give Titan an opportunity to collect on the summary judgment—rendered in default after the defendants failed to respond to Titan’s lawsuit—Chesney also permanently enjoined Antelope and its associates from transferring domain names and proceeds from domain operations until the judgment has been satisfied in full.

I remember talking to the attorney Gil Sperlien at Internext... he had just served the monstercocktube guys who were swimming in the pool right behind him. We've often seen or heard about someone getting served at a show... perhaps we'll see more of it?

So they cannot move the domain name to another company, and they cannot move the proceeds. But what about dividend payments? Paying didends to a trust and it would be extremely hard to go after those proceeds. But they'll be digging in themselves further if they do so :(

yes I read that in the AVN article post like 3 days ago and also saw the post a bit down where the forwarded the domain to a new one and still are running fine. It's just the way it is glad someone fought back, but it's like getting into a fight with 200 bikers in a bar even if your an mma fighter you are gonna lose in the end :)

There is NO WAY their profits were more than that. My guess is if they have to pay it will wipe out all profit they made on the site to date.

I agree. Tube sites don't make money. Take it from me, I own (have owned) 3. The only one that made any money was snizzshare.com and that was only because I sold it.
