It would do production companies a world of good to know exactly what is "inside the box" and what is "outside the box" with regards to the jurisdiction that their content is produced in. Too many people who want to produce content never do the research into what they can and cannot produce in the the area that they are producing it in.
What may be legal to produce in California may not be legal to produce in Nebraska. Here in Canada, the Criminal Code spans coast to coast, and blankets the country, essentially making it easier to know what is legal and what isn't legal to produce, no matter where in Canada it's shot. From what I understand, each State has it's own set of rules when it comes to sexually oriented productions, correct? Bottom line is; Do your homework before you buy that digital camera and start snapping pics of your girlfriend/boyfriend... But, when you're producing stuff like this guy, you're asking for it no matter where you are. =) |

If you know the kinds of extremely over the edge videos Zicari produces its no wonder he's got legal problems up the ass now.
Plus he takes the GFY attitude to law enforcement which is just plain stupid. But I will say one thing, if he doesn't get successfully prosecuted on obscenity charges, we can all rest easy, because those type of videos are as far as you can go short of producing snuff films. |
Yeppers, when they say their shit was extreme, they MEANT it.
They were asking for trouble with that stuff and they got it, full on. But like KRL said, it will definitely set a precedent and will be one to watch. If it fails, many sites will be using it as a defense - if it goes through, it will encourage state attorneys to go after milder targets. |

Hardcore Pornography is considered obscene in many areas. I run a lagre adult mail order company that only distributes soft core videos. I have had many oppurtunities to carry hard core products, but by doing so, the morality of these products would fall under the jurisdiction of every little county and state law where these videos end up. Solo girl/ softcore videos are not considered obscene in very many places. There are, however, several states where purchasers of even these products must be 21: AL, MS, NE, & WV.
The reason that Rob Black is having to go to court in Pittsburgh and justify the morality of his brand of pornography is simply greed. There are a couple of very good adult mail order companies out there that distribute even cutting edge pornographic video tapes. These companies take all the risk, and ask for a cut of the profit in return. Evil Angel, Elegant Angel, Max Hardcore, and many others go this route. They share their profits with a smart mailorder company and keep out of Mississippi/Utah/Pittsburgh courtrooms. |
In the box or out of the box, here is the barometer I use. I picture myself sitting in front of the jury and they pop my video in. What will the look on the jurors faces ? Regular sucking and fucking or girl girl or solo girl people might not like it but they wont be shocked. Raping someone or making her throwup on your dick that is shocking. They are going to go after people they have a good chance of winning, mike and mary fucking on bed is a so what for the most part especially when you can see people almost fucking on real sex on hbo. Want to make the extreme stuff, you make the bucks but you are asking for trouble.

Its the using the US mail that got them, they threw in the net for effect. There are probably 100's if not 1000's of hard core sites in PA, if they were going after the net they didnt have to go to CA. |
