Well, she had already told them no...that she wouldn't pose for the cover and that she didn't want to be on it. I agree that she should be flattered that she was voted sexiest girl and has the cover but to some people that's not how the want to be represented. At the very least Playboy should have respected her right to not be on the cover and just used her pic inside the mag within the story like they had been give'n permission to do.

Sometimes big business is not about doing the right thing...it's about making big profits and keeping the shareholders happy. :(

I quite agree Dean. This is shaping up to look as though Playboy overstepped their bounds with this one.

The controversy will no doubt increase publicity for Alba - but if she genuinely didn't want to be on the cover and initially turned Playboy's offer down...then she ought to be compensated properly for whatever damage to her image is determined.

Playboy is just LIke Microsoft in that they know that they will sell way more magazince because she is on the cover than they will ever have to pay if she sues.

So let's say that she sues and her lawyers will undoubtedly tell her that you don;t want to go toe-2-toe with Playboy in court because they have staff attorneys and it will cost millions in legal fees... then Playboy makes an offer to "settle out of court for an undisclosed amount". They keep a large portion of the profits from the "bait and switch" cover issue and everyone walks away happy.

Trust me the Playboy legal team ran the numbers on this a long time before the issue went to print.

i wouldnt be so sure of that - i bet her asking price fo the next film is increased not decreased because of this publicity - she doesnt exactly do disney films

Well then we can agree to disagree. I don't think being on the cover of Playboy is an honor. It's not that great of a magazine if you ask me.

The bottom line is, they asked, she said no, so they went to Sony got a production shot from them and used that.

She is on the cover because she was already voted as one of the sexiest girls, so her image as a premier sex symbol was already established, hence, why they put her on the cover.

I am pretty sure that if she wanted to be in Playboy, any time, day or night, she could be, they would never turn her down. The fact is that they had to go behind her back and against her wishes to get her on the cover.

yes they asked and she refused and shit - that is behind the point now..

the only reason she sues is to save face with her family and maybe a couple of friends

the facts are that both she and playboy will make a lot more $ from this situation - rather than if it never happened..

its a win-win - pretty simple
