That's assuming you know what type of agreement she has with Sony... never assume.

I know of 2 suits against Playboy that they have lost, or settled on, for very similar reasons. So this is not something new to them.

just walking out the door but ya - so that may be true but doesn't mean shit - they consider litigation and things like this suit publiciity just like any other advertising expense... in the end it helps the bottom line... say for example they settle for $5mil... they could not have bought all of the advertising space on cnn / abc / cbs / nbc /etc.. etc.. for that amount of $$ they win - she wins with new contracts that are worth a lot more than she would have gotten...

once again you guys are acting like she is some web girl who signed a model release and gave up her rights. That Sony photo was taken for the purpose of promoting a movie.Thats the only thing that photo can be used for, its not open ended.This is a girl with her own team of lawyers lol

Dean, Aren't you a photographer? Doesn't the person that gave Playboy the picture, and I assume had the rights to do so, hold the responsibility putting Alba where she is?

Playboy asked her to shoot for them, I'm sure they offered her money to be nude. When that didn't work they probably said "well, what about just a cover?". That's a no, too. So Playboy goes to Sony. I highly doubt they told sony we want to put her on the cover of playboy.If the purpose of the photo is to promote the movie, then thats the use of it. Your thinking of the blanket model releases we have girls sign. She doesnt sign those type of releases. lol :disgust

go to page 2 of smoking gun Jessica has specific aprovals and licenses for each use of the sony photos. Like I said she is not some web model lol

I'd bet $100 and my left nut that they specifically told them that they were printing her image in response to the poll that put her as top sexy biatch.

If Sony owns the rights to the image, and they gave it to Playboy to publish, then Alba has nothing to stand on, legally.

again go read smoking gun page 2 what kind of retard thinks a big star signs blanket model release like some $500 model. She has say where those pics go and their license.

I'm not disagreeing with you. I have not seen the release that she signed for the photo. If Sony owns the picture, it's Sony's decision. If Alba Owns the picture, It's hers. If Sony has an agreement with Alba to use it in only for specific use and/or if she has the right to approve the use, then Playboy should not have been able to get he photo.

If tha'ts the case, then Playboy would likely be able to recover any damages they pay to Alba by suing Sony, who gave them the use of the photo. If Playboy told them it was for specific use inside the magazine and not for the cover then they are wrong. I'm sure it will all come out before it's over.

And just because she's not a web model, doesn't mean anything. I have personally witnessed the signing of releases by countless celebrities. Every TV show, movie, ad slick, and soup can they appear on gets a release.

Again, I've not seen the actual papers. We probably never will see them, because the party that's telling the truth will likely either settle or dismiss the case before it gets that far. I hope you are correct, and she does have the rights to approve specific license of the picture. As a photographer, I like to see it when people get their ass banged for not respecting copyright law.

Although, I think that Sony, being the 800lb. gorilla in this story, would give alba rights to deny them ANY use of an image related to publicity. I don't think she's got that much industry chops. But, nowadays they do seem to give these whiney babies more than they should. Personally I don't see how she keeps getting work. She can't act, and there are many more hot chicks walking down LaCienaga right as we speak.
