FearFactorPorn.com told to ShutDown

This is a press release that was just announced:

WWW.FEARFACTORPORN.COM TOLD TO CEASE AND DESIST BY TV SHOW LAWYERS

FOR IMMEDIATE RELEASE

The adult website of www.fearfactorporn.com has just received a ?Cease and Desist? letter from a law firm representing the TV show ?Fear Factor?. FearFactorPorn.com was launched just two weeks ago on November 25, 2004. Like the TV show the website features contestants competing against each other in several gross/difficult/degrading stunts and games. However, unlike the television show that eliminates each of the three men and three women one at a time during three games, the website features three girls who play for points in mostly sexually oriented ?activities?.

In the letter dated December 10, 2004 (which can be viewed at http://www.fearfactorporn.com/letter1.html), the law firm representing Endemol USA Inc, the producer of the television series entitled ?Fear Factor?, claims that ?fearfactorfuck.com? is in violation of ?copyright infringement, trademark infringement, and misappropriation?. The letter also claims that the use of the ?Fear Factor? title and logo is done in an ?extremely unflattering, derogatory and pornographic manner.? The letter demands an immediate cease and desist of all elements of ?Fear Factor?.

Redslip, LLC is the small, 5 year old company behind FearFactorPorn.com. Company president Richard Prag claims it was a gamble from the start: ?We took a chance when we decided to use the ?Fear Factor? name in our website name and when we decided to use a logo bearing a similar resemblance to that of the television shows?. What I did not expect was for the lawyers to come calling so quickly.? But according to Mr. Prag the show will go on. He has no plans to shut down the website, although he is considering the possibility of changing the name and logo to a less ?controversial? one.

Sincerely,

Kevin Prag

No suprise there unfortunately, I saw a fear factor porn movie clip on Consumption Junction today and the 1st thing that went thru my mind was lawsuit.

Too bad, kind of a cool concept.

Didn't see that one coming... I saw the site last week and wondered how it was still up.

SmokeyTheBear 12-14-2004 01:07 AM

using that logo and that name the only thing they could have been thinking , is using it for the potential conflict it would cause.

yuvalus 12-14-2004 02:35 AM

this lawyers will do anything for some $$ huh?

TheMob 12-14-2004 03:20 AM

ah, good idea to play on it.. you should send press releases out.

rickprag 12-14-2004 03:40 AM

Hey Everyone! This is Rick, the guy behind TubbyBucks.com. It's great to see some support out there! Regarding this whole FearFactorFuck thing, I knew fully well that the TV show lawyers would grab ahold of this, and thats part of the reason I chose the name "FearFactor". This is a great opportunity to grab some publicity. Does anyone remember Bum Fights before they landed on news reports? Don't they say "there is no such thing as bad publicity?"

Anyway, the website isn't going anywhere. We have some unbelievable content that I really believe in. In fact, we're shooting two more episodes this weekend, so if anyone has a wacky idea they would like to see on video please share it! Worse case senerio is I change the name and logo on the site. Also, I'm making a new tour, so conversions should pick up!

Now, regarding the nn.com site some of you know about (if you don't know, ask a friend), it has been difficult to both host and process payments for. Apparently, even the liberal adult industry finds this subject "taboo". Everything we've done is completely legit and legal. I still think its a great idea, and there certainly isn't anything like it.

Well, thats all. I look forward to hearing your thoughts.

I wonder how much lawyers charge to write those C&D letters? $1000+ for that one most likely

X37375787 12-14-2004 04:49 AM

I can't even start to describe what I think about the nazi******s site.

:BangBang:

Kard63 12-14-2004 04:53 AM

This will be great or terrible for them. I'm guessing great.

That is some real fucked up shit. I guess i won't be pushing tubbybucks anytime soon

NaughtyAlysha 12-14-2004 05:15 AM

I kinda thought that would happen the first time I saw the name. Good concept, though... perhaps a name change and keep on keeping on. :thumbsup

William-Xfactor 12-14-2004 05:38 AM

Good I hope they sue their Asses off while they?re at it.

I?m sure when that site was spammed to me a couple of weeks back, I had a look and seen a game that involved crapping on a girl head and seeing how far she could fling it.
No wonder there is so much heat on the industry.

EDIT: WAKE THE FUCK UP WEBMASTERS

robfantasy 12-14-2004 05:53 AM

nnweb 12-14-2004 09:51 AM

why not just change the name and logo to something else?

seems like allot less drama.

:)

Yankee Scum 12-14-2004 11:08 AM

hehe

I would probally setup a domain + new logo...

and keep buying domains to get the publicity.. .this way the memberssite will always be up :-)

LadyMischief 12-14-2004 11:11 AM

Well gee, what made you think those kind of blatant copyright and trademark infringements would just be passed off or glossed over by the tv network? Kind of stupid, if you ask me.
