kayla ryder will sue me for kaylaryder.com
I don't even want this dude's garbage little domain. It
was in a bulk pool of domains with overture results. Need to get a trademark filter. Get out of my face with your garbage domain you forgot to fucking renew. I did you a favor, you're lucky some Chinese dude didn't get it. I always give trademarked, expired domains back. Anyone wanna buy this domain from me? lol just kidding ----------------------------------------------------------------- Dear Josh, During a transfer of domains from one registrar to another, www.pool.com or yourself, managed to register www.kylaryder.com as your own during the brief period of time that it was available. This domain has been used as advertising for Kyla Ryder Productions Inc., and has received a many as 30,000 visitors in one day. All of our business cards, promotional material, and website links go directly to this domain and display this domain. Kyla Ryder, in case you are unaware, is a well known exotic dancer and adult film star, who performs all over North America. She has a large fan club and a following. As it is a performance name and not her true name and is a distinct name that we have not seen reoccur anywhere, Kyla Ryder is a legal trademark of Kyla Ryder Productions Inc, a registered Canadian federal corporation. You are in fact, violating our trademark, which will not be tolerated in any way. This is no different than you registering www.clinteastwood.com or www.mikerowsoft.com . My network technician has now educated me on the practice of "cybersquatting", which is precisely our current situation. He has also informed me that it is in fact illegal and that it can be easily reversed. I am going to present a few options to you, so please consider them carefully. The first, and best option for you, is that you hand over the domain back to us, and we will pay you a modest amount of money. And by modest I mean the amount it cost you to buy the domain. If you wish to return with an extortion figure, the answer is already an emphatic no. This requires an immediate response on your part. I have already contacted our company attorney, Andrew Atkins of Andrew Atkins and Co., who will be sending you an official letter notifying you of your trademark violation. This will effectively prevent you from denying that you don't know anything about this trademark violation. "The address you have is not correct" will not be an acceptable excuse to a judge, as it is your responsibility to change it during the registration process. The next step we will take tomorrow is filing an offical complaint with www.icann.org. They will likely reverse the domain and you will lose whatever you paid to register it, although this will take time and company losses will be sufered. Please note that both McDonald's and Hotmail had similiar situations where people thought they could snatch their respective domains. You will not even be contacted, but will simply lose your registration and whatever you paid. If you wish to take it to this step, then you will be served with a claim for damages from our company. I just purchased 4000 posters displaying the domain name www.kylaryder.com, as well as 10,000 business cards and flyers. If we are forced to change this name, even temporarily, we will be seeking damages in the $1000's of dollars. If we can prove lost revenue and claim legal expenses against you, expect the claim to be in the $10,000's range. My attorney is $300/hr, plus travel expenses to your area, which you will likely be paying. Do not assume that because you live in the US that you are exempt from any applicable laws. Any country that subscribes to the Stockholm convention shares the same copyright and trademark legislation. Please see the attached documents, proving our business registration as well as the use of KYLA RYDER as a performance name. Also please consider that Kyla's DVD sales, tips, and private dance revenue is often twice as much as her paycheck. We also sell a considerable amount of DVD's online which we are currently losing revenue from. We will be calculating her current sales without the website present and comparing it to last years sales. You can expect the difference to be added to our claim against you. If she was averaging $4000 a week before and is now averaging $3000 a week, expect a $1000 to be added to this claim for every week this takes to get our domain back, starting today. These are not exaggerated figures. I require a response within 24 hours or I will begin the process of legal action, Sincerely, John Biley Kyla Ryder Productions Inc. 148 19567 Fraser Hwy Surrey, BC, V3S 6K7 |

I'm guessing he had to be an ass like that just in case you did register it maliciously, so he could scare you into giving it back.

She's a local stripper from BC that did a movie with a few other dancers. I think they registered the stage names of all the other girls in the movie for themselves :helpme
|
I love how they act like it's your fault they forgot to re-register their beloved domain.
|
because the guy was an asshole , i would find a kayla ryder in the phone bok, tell her your from a non-profit organization that finds people names in domains and gives them away. Transfer it to her and tell buddy he should have said the magic word..

What the hell is he doing making posters and shit if they don't even own the domain name?? Who is the idiot here? I wish ICANN would see failure to renew a domain name as forfeiting the rights to it. But alas, too many big companies fuck up and don't want to suffer for their mistakes. |
the domain in question isn't even hosted... how can it be making any money?
those guys are total douche-bags |
sell it to someone else that would want the name for more moeny and let them deal wit it:)
I was in a exact situation few years ago, I had a gaming site, which i registered before a company even bothered to get the .com. So one day, i get a email saying to hand over the domain name, but i told the guy fuck off or give me $$$ for it. Then he gets all pissy and starts saying he'll sue me and shit. so my host, who I kinda knew through chat, said he'd buy the domain off of me for $500 cuz at that tiem I was a scared 15 year old who didn't want a law suit, plus $500 sure was a lot. He then tells the guy that if he wants to fuck with someone, he can fuck wit him and his lawyers. and then he gets an apology letter and then never talked to us again ;) |
I used to own WXYZ.com and got a C&D from Scripps Howard.
apparently WXYZ is a registered trademark for a tv stations call letters they own somewhere. I nearly shit myself reading it, but just got pissed. I placed the old ZMaster pic of the chick flipping the bird on the site... and the lawyer cunt called me and yelled at me. "we are not amused". showed the shit to a few people... some said fight it some said turn it over.. i turned it over. I never did get the $75 she promised me. |
I know of a pharmaceutical company in Florida that has been fighting with a guy in Canada to get their registered trade marked name in .com for about 5 years.
If you bought that name with the intention of using it, then I dont think that it is cybersquating. I think that is only when you grab a name with the intention of sitting on it for the biggest offer,or do nothing with it. I would talk to a lawyer before I gave it to them. :2 cents: |

I would make him pay me for the time and money used to register the domain along with development time that will be lost. Just bs him a little and he will pay for not saying please...

|

JK, lol. For half the replies in here, don't be dishing out legal advice when it's obvious you know jack shit about domain disputes. |
Good reading. :thumbsup
|
if he does take it to WIPO, good chance you'll lose and have a blemish on your clean record, if that matters to you. LOL. explain to him that he let it expire and tell him if he had only said PLEASE, you would have transferred it right away. it's very nice that you're willing to give him the name back, says a lot about your character. :thumbsup
|
What a fucking douche bag. At least make them sweat a little and definitely dont just give in straight away.

to call this case a cyberaquatting so pisses me off. Many people called me a cybersquatter and I am not a legal expert but I bounced all their little ignorant threats. cybersqatting, oh boy... |
Oh please dont just give that name back. If they wouldve sent you a mail asking politely if they could have the name back and pay you 200 bucks for it whatever id say give it back without taking the money. Now i say fuck them. Even if you give it back right away send them an email please telling them what a morons they are for letting the name expire.
|
that guys is a fucking tool, yea fucking right it was transfering over to another register. This guy just fucking forgot to renew it and he is shitting bricks now that some one else got it.
Damn fuckin morons.. I am suprised his signature didn't say "Have you seen my baseball" |
Please tell him he only had to say please and you wouldve transfered it. Make this idiot realize he's an idiot.
|
Fuck him keep that shit.
And if your gonna give to him don't do it right away, let him walk around with his panties in a bunch for awhile. :321GFY |
