I'd be suing the fucking webmaster and technical guys who should have been watching the name. Hell even I get an email letting me know if a domain is coming up for renewal.
Big deal if they bought all the stuff, hell buy a Hummer and put her name on it, much less a house for business - sue him for millions if you want, its not going to make a bit of difference since the responsibility is on them to renew. They should be suing those that they bought the URL from at the beginning that they werent informed that it was up for renewal... classic case of jumping off a bulding, surviving, then suing the owners of the building for not making it bigger. |
It's all about who has the money in this situation. Many large corporations do not own the urls for their trademarked names. Great example of how it works is www.nissan.com Uzi Nissan is a pretty great guy, Nissan the car company got pissed off that he would not get off "their" name. He had this domain registered when Nissan heads in Japan outcasted their engineer here to America and told him he could only call his cars Daihatsu, Nissan did not even exist here yet by their choice! But what they did is file for "damages" about 2 years ago saying his url has done millions of dollars in damage and sued every business he owned as well as businesses he was a partner in even if Nissan did not appear anywhere in public documentation. It all started with a pretty rude letter. Likewise most car companies do not have their registered trademark names in direct urls. So it does not matter who had what first, it is who wants to pay for it. I would make him talk to me like an equal.

I would keep the domain name considering that they were never even using the domain name to begin with. You bought it fair and square. ITs nto your fault they let the domain name run out. When renewing a domain name you get tons of emails saying it is going to run out. I say keep the domain name and let them pay you lots of money for it.
