My apologies to Brandon/FightThisPatent
After meeting Brandon in Miami, I was confronted with the ugly truth.:1orglaugh
He's a good dude and I have no doubt that he only had the best of intentions regarding collecting money to fight acacia. Now that doesn't change my opinion that it wouldn't work. I would just like to say that I now understand that he wasn't trying anything underhanded to line his own pockets. |

Yes, Brandon is a cutie isn't he....
Those of us who have known him for a long time, know that he is genuine. He cares very deeply about things, and is generous with his time in 'trying to make things happen. It is not unusual that a "do-gooder" in this biz is not taken very seriously, and a ulterior motive is always looked for. There are just so many scams out there, by uncrupulous people, it is hard to believe that 'anyone really cares about the industry. After the verbel beating he took - I am surprised he is still here. Most would have said 'hell with ya.... Nice post 12Clicks....(I do think this may be a first:-) |

While things are going very badly for Acacia, they are still sucking up to $100K/month from the Defense Group members in order to drive the nail into the coffin. Acacia is still proposing to roll up the entire industry into a class action lawsuit, and the Defense Group are fighting to shoot that plan down as well. For those that followed the drama when i said i was stopping my full time efforts and going back to my ventures, you can see the fruits of that effort at http://www.2257lookup.com and http://www.t3report.com If you keep up with http://www.fightthepatent.com or on the Yahoo board, you will know I have never stopped tracking or skewering Acacia and continue to reveal the truth about their efforts. For those that didn't know, I have been providing technology to adult biz since 1997. I stopped going to the shows in 2000, and recently popped back up with 4 conventions this year. You will be reading more about my efforts to use technology to solve problems in areas like helping to proactively shutdown CP websites through my work with ASACP. Helping webmasters and content producers with their 2257 record keeping requirements, and as always, watching out for Acacia and other potential patent threats. Many compliments to 12Clicks for making a public apology. Kudos for demonstrating such strength of character.
Brandon is indeed a great guy and I am certainly thankful for his incredible efforts. We continue to smash Acacia but they are still quite determined and even though the stock has dropped precipitously, they are still up to the same old same old. They are still trying to get a Class Action suit against the industry and who knows what kind of trick they will pull next. We will continue to fight them and be grateful for the people like Brandon who have stood shoulder to shoulder with us in that fight. |

Brandon is awesome and I'd love to discuss legal issues with him as I have two lawyers in my family. I am always interested in the psychology of people who are dedicated to a cause.

The USPTO doesn't reexamine any patent that is already tied up in court, and that was his advertised proposal for the $250,000 concerning Acacia. So even if it would have made it off the ground, it seemingly had a zero chance of bringing relief from Acacia anytime in the near future. |

In addition, Acacia is not the only patent that the adult industry should be concerned about. I have been saying for months there are many other patent holders watching Acacia's actions. With a non-profit established, it would be on guard for the next ones to come (ie. be proactive) and also be reactive to the Acacia case in assisting webmasters. There are many patents that could be directly challenged at USPTO for a re-exam, BEFORE they come out swinging in litigation. WHEN the next patentee comes in, you think webmasters are going to be prepared for it? Look at the defense group, they are spending their hard earned profits to help the industry. They can easily settle for micro pennies on the dollar and allow Acacia to really steamroll over all the other businesses who aren't in a position to fight.
