Content provider tryin to screw me over!
 

So here is the deal...I placed an order with a content provider (for now, they will remain nameless) in late September for a total of 900 exclusive photos.

The order entailed 3 solo girl shoots @ two sets of 100 photos per girl (600 total)...As well as 1 girl/girl shoot @ two sets of 150 photos (300 total).

They were to be taken out of location...By the end of October, I had received 400 photos and was told the rest would be completed back on location when he returned...I sent the provider over $400 worth of props to use in my exclusive photos...

So, at this point I was still owed one more solo girl @ two, 100 photo sets and 1 girl/girl @ two, 150 photo sets.

I was then shown a model that worked out very well for my needs...I wished to open an exclusive site with this model, upon certain terms...We agreed and I told them to shoot the remainder of the pics owed with this model and I would be order more when the site was developed.

I was told by the content provider that 200 photos had been produced yet the download only contained 100...The provider had "accidentally" deleted 100 of them.

Between that point and now, I have yet to receive the last 400 photo's I am owed...I was notified 3 days ago that the model to be used for the site was no longer reachable and no future shoots would be able to be done.

Ok, no biggie...Told him to just get the other 400 done with whomever.

With only 100 photos of this model, I had to do something with it, so I created a small free AVS site with it...Upon advertising the site, one of my biggest competitors links to a pic of what? Yup, the exact same model in the exact same setting using the very same props I sent him for *MY* exclusive content. Just for clarification, he didn't sell the same exact set he delivered to me, my best guess is that is where the "100 deleted" photo's went.

For now, lets just forget the fact that he sold the same exact model using my props to someone else when there was an exclusivity agreement for the site...

I decided to pry a little bit and joined my competitor's site, low and behold, what do I see?

SEVERAL sets from this same provider all using MY PROPS...There isn't any confusion here, these are absolutely the props I had sent him to use for *MY* exclusive content order!

I was never asked by the provider if he could EVER use them in any other manner besides my own order.

Now, there seems to be a misconception on the "exclusive" part as you can see...The exclusivity was discussed on ICQ and no "contracts" were signed...I still think it's really low for them to sell the same chick I was going to open a exclusive site with to my competitor tho...Fine, whatever...Honestly, it's actually not that big of a deal to me.

I would just think that they would have enough grey matter to know that selling the same exact girl in the exact same niche to my competitor while I ordered and committed to future orders of the girl for that site.

Why am I not telling you who it is? Because, people fuckup...This is really bad IMHO...But I want to at least give him a chance to make it right before I say who it is...I do have proof of everything stated here and several reputable people have seen it...I just don't want it to come to that if it doesn't have to.

I suggest you stop ignoring me and contact me to get this resolved immediately!

Yeah, I agree... ICQ has no legal bounds.. it's part of what sucks about doing business with people way beyond our reach for a hand shake or signing of papers.

however, that being said... it's still good to know who'd agree to something on ICQ to you and then turn around and do something else behind your back.

It's not even really the exclusivity that bothers me...It's that he used my shit I provided him to shoot content for my competitor.

What puts me above my competitors is the fact that I invest the time and money into making sure it's done right and with quality...That's what keeps my members.

Then he uses what I supplied him with to shoot content and sell to my competitors, thus essentially stealing one of my biggest advantages. Mind you, the props were strictly for my order and to then be sent back.

Not once did he ask what-so-ever for permission to use them, nor did he have the right to.

You need to post a name.

One to protect the others who might do business with this guy, He will be out there ripping off others as he did to you.

Two, to show us what kind of person you are dealing with, was it a mainstream guy like us or did you go for a guy based on price?

We know there are many content providers out there who are honest and straight, who do a good job and will stick to their word. Unfortunately they are busy and not the cheapest.

So tell us who he is or are you using this as a lever to get your money back?

He does alot of business.

Yes, I do want some sort of resolution on the matter...Not only has this all happened, it's been nearly 3 months from the order date and he has yet to complete it...That's just ridiculous!

He doesn't even seem to be the slightest bit willing to do right by any of this, which is what bugs me most of all.

Also, after several requests, he has failed to send me the appropriate model releases and ID documentation for the shoots he did do.

But I'd imagine that people who are screwed over would like to see some kind of resolution from it. You know? maybe get what they paid for at least? Or to just get an answer at all? I mean, you don't just throw money at someone, get nothing and go "oh well, it's lost."

Usually you TRY to get your money back, or what you paid for. If not, THEN you expose the person.

all i can say is that its suprising that a content provider of this size would do something like this but hey anything for a quick buck right?

It would be intersting to hear the price for the photos you have agreed on, because many producers which are offering you exclusive stuff for a very low price are cheating and you can see on the prices that it never could be for exclusive productions

Very true, so how much was this deal for?

A client buys exclusive, that means that model/models in that setting and scenrio. However some producers think it means those shots, they then produce twice as many and have a set to sell.

But using your props on another shoot without your permission is unfogivable. Always insist on having them returned.

As well as the price, tell us is he in the US?

expose the content provider Fatbrain, it would be good for potential customers of whoever it is to be forewarned.

RedShoe is right about ICQ however this industry is not based on contracts alone - there's a lot of trust and reputation involved. I think you'd be better off if you stick to reputable content prviders. I have a strong suspicion who's the CP in question but I guess it's up to you if you want to expose him or not.

Fatbrain showed me this yesterday and told me who it was. Sounds very sneaky and I'm quite disappointed in the provider who did this. I know they post on here and they need to reveal themselves and tell their side of the story..........that is unless it's all true. Your silence is making you guilty!

My main issue is that he didn't even TRY in the slighest way to say, "Ooops, sorry man, lemme make it right."

It was more to the tune of, "Fuck off you piss ant!"

I have seen the info as well and i know who the content guy is and i got to say what a fucking jackass. You figure he has a lot to lose once his name gets out as a scammer. In this business you go by your name and once you lose all respect your done for good for what an extra couple thousand. That?s just ridiculous

i have been waiting 6 months for the rest of my stuff and i have been far more then patient (i believe) so before i actually start posting, contact me. who knows, maybe we can take care of two problems with one bat :winkwink:

He is a mainstream guy and posts here, hence why I posted here as well...I went with him for several reasons, price is one, but more so that a few people referred him...Generally that is what I seek when looking for new services or programs.

The price was $800.

He knows this thread is here, myself and others have notified him of it's presence.

But, it's very possible that his plans were to do as you mentioned, shoot twice as many and sell them...Like I stated previously, it's not really the whole exclusive thing that gets my goat, I can agree that we both have different definitions of "exclusive".

What does really bother me is that not only did he use *MY* props to shoot for other people, he used the exact same ones as he did in my shoots.

The shoot is damn near identical to the one for me...The only thing different is the bed she is on...Hell, he even used the same props as in the shoot I received.

As I said above, he told me he accidentally deleted 100 pics...I'm thinking it's more along the lines of he sold them.

He was aware that the props were to be returned...But, due to the fact that he had yet to finish the job, I had not requested them back just yet.

To the best of my knowledge he is a reputable content provider, he does a lot of business here.

i just had a very nice conversation with fatbrain and yes he and i are having the same problem with the same content provider. posting any further info about this provider is going to cause a problem for this provider for various reasons.

i feel bad for fatbrain cause hes just trying to do the right thing the right way and leave it to "someone" to screw with fatbrains trust. sheesh some people just dont get it.

As a shooter of porn for many years i can tell you that anybody making you wait 3 months for your content is not practicing very good business relations. These things get out and they will end up with a fucked up reputation.
We charge our clients $1200.00 for 100% exclusive images and video per solo model up to Hustler style.
For that our client gets all images and video shot during that session all props supplied are returned and all we keep is a copy CD attached to the IDs and model release for USC18 records. No copies are sold to anyone else for any reason and that we guarantee 100%. Our clients get a copy release and model IDs along with a CD full of 500+ . seven meg images and 30 mins of raw mini DV, usually with 7 days unless we are asked to work on the images or the client is in Europe which adds about 3 days to mail times. That is my idea of exclusive content ?

Sorry, you're other producer didn't work out for you. I know who you're talking about. I've had problems at times getting content to people at the last minute...but somehow after hundreds and hundreds of scenes, we always manage :)

Waiting as long as you have with no contact is uncalled for and hurts any of us pro's in the biz.

PS...you're going to love the scene we did for you today....one of the best yet for your project :)
