So... I need serious domain advice please step inside...Funny Story..

So this is my situation:

I own a domain named DaddyIssues.com

This is my email exchange with this hooker!

From Violet Benson:

Hi David,

I noticed that you are currently the owner of daddyissues.com and I was wondering if you are using it. I have a funny account on instagram called daddyissues_ where I make no money but I just enjoy making people laugh. I wanted to expand with my writing to continue to entertain people as my hobby but noticed that the domain name daddyissues was taken by you. I was wondering if there was any way you would consider giving me the rights to this domain name since it does not seem that you are using it at the moment. Let me know!

--
Thank you,

Violet Benson

Twitter: Daddyissues__
Snapchat: Daddyissuess

Me:

Not really interested on giving it away.

I turned down 8k last week for it.

Sent from my iPhone

Just Dave

Violet Benson

Nice...so you just keep it waiting for people to offer you money for it? got it. I am going to trademark that name anyway so we shall talk then. xo

There are a few more exchanges but this gives you the gist of whats going on.

Now today I'm getting GoDaddy emails from go daddy trying to broker the sale of my domain name.

Im curious if this is a precursor to a possible lawsuit to acquire my domain name by force for possible trade mark infringement.

Has this happened to anyone before?

Any advice? Curious.

I wouldn't worry about it. And you know you did not get offered 8k for that domain.

ITraffic 02-06-2015 02:55 PM

i think she has some daddy issues herself.

CaptainHowdy 02-06-2015 02:58 PM

She does have daddy issues ...

suesheboy 02-06-2015 02:58 PM

how long have you had the domain. Did you do anything with it at all?

AntonMG 02-06-2015 03:00 PM

I assume that as long as the domain was registered PRIOR to the trademark you should be fine.

You are absolutely correct!

But when you say something stupid to me like: "Why don't you give it to me for free", I come up with something just as stupid.

Sort of, see Nissan Computer Corporation

BlackCrayon 02-06-2015 03:13 PM

Just another idiot that will disappear eventually. And any trademarks that come after your domain registration mean nothing.

You'd be surprised what some will pay for a name. 5 years ago Deutsche Bank bought my AlphaFlash.com domain for $00,000.

I was approached via email in the same way as Just Dave and their rep offered buying it for $500 or something.

I'll research this DaddyIssues thing for Dave and see what's up, if anything :thumbsup

7 years I think.

Im a busy shooter. Was drunk and and joking around with a room full of people when I bought it. Sobered up and i thought it was a pretty cool name.

Im always down for suggestions. But to give it away for free??? No way!!

Thats what I was thinking. But I have a friend that had this situation with a monster online company where he bought the domain name, shot up a site around it.

The company he was at odds with went out and trade marked the name months after the site launched. When he came came to negotiations to exit the company, he had to pay out 75K for the trade mark transfer and ownership.

I know this happened for a fact! And I cannot reveal the players and companies involved. So please don't ask!! I absolutely know this went down!!

With what I have seen go down in the past, is why I'm asking what I'm asking.

Don't care so much about the name, but i will go mental if someone bullied me and took what is mine. I don't take stuff like this with out a fight. That includes coming over to your house.

I will give it away before it gets taken away!

So Neil Autrey filed a Class 035 Trademark for Daddy Issues this year 1/28/2015

and it looks like someone might have challenged the Class 025 Trademark held by another party, and they filed a TEAS STATEMENT OF USE on 1/30/2015 to avoid having the Trademark voided.

and ...

A Voilet Benson LLC was registered in California with the principal address being 520 S Burnside Ave #7c
Los Angeles, CA 90036.

Neil Autrey is a fashion designer. See his Huffington Post interview here. The Word trademark, Class 025, is for clothing and apparel.

I am no expert, but I think the fact that you use the website for something has its importance as well. If you don't use it for anything I think it falls under "cybersquatting".
I remember a time when whitehouse.com was a porn site.
I'm pretty sure the 'merica gov did all they could to get it back or at least get rid of the porn content.
It's now a parked domain.

Fun fact: the domain has been blocked from the wayback machine: Internet Archive Wayback Machine

You'd be surprised. I've seen them taken away even in those instances. But I don't think she has much to go on since she has to be in business to actually trademark it.

I totally agree with you. your dead on with that statement.

But there are cybersquatting laws. Don't need some girl trying to trademark that name and trying to force me to transfer it at a later time. Its funny, but its a real situation.

It's a dude

Think about it. Male fashion designer Neil Autrey wants to start female line of clothing called Daddy Issues, creates Violet Benson, LLC as the company name :thumbsup

To make it clearer:

He owns daddyissuesapparel.com

He has a clothing line called Daddy Issues Apparel

this is him model some of his clothes

Weirdest thing ever. If I hit reply to you Tom, it takes me to your birthday post to 420!

Crazy.

Anyway did you look at her/his twitter?

AdultKing 02-06-2015 03:52 PM

I'd be putting a fairly generic site up on that domain and let them fight for it.

Why don't you let him know you are onto his gig and the made up twitter story and address him by his first name Neil. You don't seem that interested in the domain, so why not sell it. Start some negotiations with him and see what happens.

I agree.

@JustDaveXxx It's not like they are poor. They are registering the trademark & creating the LLC just for this product line. Neil Preston Autry has his long time girlfriend Caroline Grace (Curaline) aka Caroline Winkler and their son. Oddly she states on her twitter that she owns Daddy Issues Apparal, but it's registered in Neils Autrys name.

I find it odd the money being spent on Trademark & LLC, yet she tweets linking to her GoFundMe trying to raise $2,500 for a new car and going by Caroline Winkler and Caroline Grace (Curaline) on that page.

The GoFundMe started January 9th, 2015, the same day the Violet Benson LLC was created in California , January 9th, 2015 and the Trademark was filed on January 28th!

They are 2 beautiful happy people with a kid, and both are obviously very creative and driven. Strange scenario if true

You're welcome

Entity Name: VIOLET BENSON, LLC
Entity Number: 201501410548
Date Filed: 01/09/2015
Status: ACTIVE
Jurisdiction: CALIFORNIA
Entity Address: 520 S BURNSIDE AVE #7C
Entity City, State, Zip: LOS ANGELES CA 90036
Agent for Service of Process: ROBIN SAGHIAN
Agent Address: 170 S BEVERLY DR #315
Agent City, State, Zip: BEVERLY HILLS CA 90212

I think there are probably a couple different players involved in the whole trademark thing. The daddy issues apparel duide is based in midwest. The daddy issues girl is in LA. 2 complete different entities. I read her twitter and instagram and she is kinda funny. I figured i would poke her alitle and I sent her an email telling her I had recently purchased the domain daddyissues.com for 8k and will be putting a stripper forum on it and inviting her to join when it is officially open.

@NaughtyVisions No underwear! but I missed the 5 minute deadline :(

rogueteens 02-06-2015 05:39 PM

keep the emails, surely that would scupper any disputes they could possibly bring up

mikesouth 02-06-2015 05:57 PM

she is a moron....the idea was not a bad one...you arent using the site and she wants to incorporate it into what she is doing...id give it a quick lookover and if i thought it had potential Id say

I will not give you control of the domain but I WILL set it up so that you can post to the site via wordpress or something and we will see what it does from there, if it can make money Id be happy to cut her in.

that should have been her approach....

the idea that she can trademark it AFTER you own the domain and then try to take the domain from you is purely retarded....trademark law in this case would come to first commercial use which you could claim simply by purchasing the domain probably.

You neednt worry...if I had a dime for everytime some porn person said they were gonna sue me Id be rich...even Karen Tynan decided that wasnt in her best interest.

dont sweat it...nice url though! if you ever decide to commercialize it as a humor type thing I got lotsa stories i will give ya for it.

epitome 02-06-2015 06:18 PM

Offer to rent it to her for $150/mo. That way you retain control, but she can use it... and you've monetized it.

Domain renting has been a thing... well... for as long as there have been domains.

You never give her control of the domain through the registrar. You just point the nameservers to wherever she says and agree to setup any other DNS records she requires (cname, mx, etc.).

Complete a rental agreement (there are plenty around and pretty straight forward to the point where I doubt you'd need an attorney) to remove liability for her content. It's the same as renting equipment to someone. Or anything.

The Porn Nerd 02-06-2015 06:21 PM

Come on man, turn that gold into a paysite!
There's enough teen porn out there, you would clean up. :)

Then if she DOES sue you the publicity will make you money. :)

It's been a long time since I've seen gold and paysite used in the same sentence.

Thanks for the laugh! :upsidedow:1orglaugh

You of all people should know that a domain is about 0.10% of a site's success.
