I wrote this yesterday and saved it to note pad, was thinking I may have been just pissed and didn't want to make an ass out of myself as norml. But after looking at it again FUCK IT. People need to know.

Ok Long story short. Last week I get a complaint that one of my models looked underaged from a surfer. He was pissed and shit.
Well I contacted TOM DAVIS aka MagicMan aka 007alien what ever else his names are. Well I get this today.

alot of content licensed in this industry is done without the licensee having any idea if the models are legal. how many people who license content include a photocopy of the ID's with the download?
most people just trust that the content provider has all the documentation, that it's all kosher.

I don't see what the harm is in showing customers the ID's with of course the models real name and location blurred, the date of birth and photo is all anybody wants to see.

Bottom line is that you have to trust who you are buying from if you really want to be safe, anybody can fake ID's and lie, the brokers who buy from small guys who they have never met in their lives, from countries where who knows what goes on, are much riskier.

who was the photographer ? maybe you can find that out and "deal" with him directly.

that is the most unprofessional thing i have ever seen. if the model is underage and the content provider sells those sets. that can get a ton of people in a shitload of trouble.

no ya prolyl wont get ya money back unless ya do a chargeback or something maybe like that I am more pissed i trusted him and gave him good referencing to MY friends. OH yea im even more pissed I now have to take down his shit content as well. Thank god Im buying 600.00 worth of live feeds and live chats from 2 companys mayvbe this will help shrugs, but as far as buying content again NEVER NEVER NEVER I will go back at taging toothless whores before I do that again.

There are ways to seriously fuck with him and fuck him up if you want to get it done.

I bought this shit too, I just filed a complaint with PayPal to get the money back, we will see what happens.

I do have a suggestion: if you're going to buy licensed content buy from someone like Ounique. I've sold some of my sets through them. I provide them with an id/release or it doesn't go up for sale.

Or you can buy exclusive content. It's really not as expensive as you'd think. My clients get copies of the id, the model release, and a brief bio on each model. They own 100% rights to the photos to do whatever the hell they want to do with it.

I don't fuck around when it comes to age. Sometimes I'll have an 18 year old girl come over to shoot and she decides to bring an underage friend. The friend wants to sit at the house and watch TV or something while waiting. I tell the model that her friend has to leave or the shoot will no begin. I don't want anyone underage anywhere CLOSE to the house when I'm shooting.

I personally have been getting mine from JactContent.com and Cool-content.com if I get any at all and I think I'll stick with them.......

Now on another note let me ask this so i can get it off my mind! IF you are going to broker content or sell it shouldnt you have all the legals taken care of and on your desk? Should't ya have it on the puter as well?

Yes and no. I personally think you should, however...From what I have seen from some brokers is that they simply have you sign a form stating that you have everything to make it legal. They then should be listing the shooter as the records holder in the 2257 area of the sites or on the license agreement.

This is just one reason that I have never used a broker and the only images I broker are those from a good friend who's house I can drive to and burn down in about 3 hours if he fucks me over. :glugglug

as a rule of thumb - if I dont get a pic of the model holding her ID I dont buy the content

I have said MANY times that the boards are not my primary source of business. People that I do the majority of my business with are people that I have met at shows. They know me personally...not just some random name in cyberspace.

Be a smart consumer and research things before you buy. If you go to the shows...Spend a few minutes talking shop and networking. The beer will still be there when you are done.

Aaron's right, i took a look at one broker's procedure/agreement for selling a photographer's work and it sure looked like pretty weak, some day somebody could go to jail using one of the brokers.

here's another thing, let's say one of these brokers, who don't like to give a licensee a photocopy of the model's ID's, decides he's going to go out of business, and he just shuts it down and disappears off the Net, or his house burns down and all the records go with it. Hundreds of webmasters out there with no way to prove a model is legal.

good point Aaron... its nice to know who you are doing business with... but again.. its no guarantee that everthing is still 100% to code... we had to remove images from some of our tours from David Lace studios... the excuse we got.. "oops sorry forgot to get that model release... well replace the set".... wasn't about the $$$ or the set.. it was about the fact they sold us illegal content...

something we do.. is include the model relase and ids on each cd... and we photoshop off all of the personal info.. except the stage name and birthdate.. .it still not perfect.. but it lets our customers know that the paperwork exists... I also invite anyone in to my office to see them for themselves... and have even sent to law offices for verifications...

Every broker I have researched is 50-55%. Not really such a bad deal if you can not move it on your own. The content is just sittig there anyway. Better to get 50% of something than of nothing.

On the flip side.......If you do not know how to make the money on your own in the content business then perhaps you should look for another line of work.

When this shit happens I just sit back and wonder. Why is it that when I bash a content provider on the boards for looking like a fly by night operation that I am frowned at? This is why i do it and it is shit like this that gives ALL of us a bad name and costs us business. 2 or 3 people have said that they will no longer buy content after this problem. How is that fair to Charly, Dan, Myself, Don, Jon, Unseen....etc...

There are reputable content providers out there and not all of their content is over saturated.
