Too Much Media / NATS: Class Action Lawsuit Now Forming
 

I am going to begin contacting attorneys who specialize in mass tort claims (class action) lawsuits tomorrow and gathering potential class plaintiffs for the breach of privacy that affiliate webmasters, porn surfers and program owners have suffered as a result of the actions.

It is my belief that Too Much Media violated the laws of several states when it failed to promptly notify its customers of the security breach it had experienced. As such, I believe that TMM is liable to consumers of porn, webmaster affiliates and program owners in amounts yet to be determined. Because the breach happened at TMM's office server - by TMM's own admissions - I believe that TMM and not the programs were responsible for the required notifications.

This legal action will not be prosecuted by me as I am not an attorney licensed in any state to practice law, but rather I will act as an organizer of data and information and perform a through and exhaustive search - without fee or compensation of any kind to the class or its potential members - for suitable, reputable and qualified counsel to litigate the claim on behalf of the class.

• Your Legal First Name
• Your State of Residence -or- where your Firm is Incorporated
• Your Status (Program Owner, Porn Buyer, Affiliate Webmaster)
• What documented losses or intrusions you have suffered to date, including receipt of spam, junk faxes, telemarketing calls and other such intrusions. Please save these messages, they may become important evidence later on.
• How many instances of NATS you have installed.
• How many site memberships you have purchased from NATS sites.
• How many affiliate webmaster accounts you have on NATS-based systems, as applicable.

If suitable counsel is located and retained, you will be contacted again by e-mail and asked to provide full names, addresses and phone numbers, which will then be provided to the class counsel and they will contact you to obtain any further information they need.

You realize that if NATS/TMM disappears, there will be no more updates to any TMM software which MANY programs/people rely on? If any security issues are found down the line, with the encoded source there will be no one around to patch them. This would lead to even further data leaks...

At the end of it all...
Its just not worth pursuing and flushing over 5K just to get things looked at and who knows how much after filing anything.

I'm not here to address this guy anymore as this is clearly a legal matter at this point (I don't see how anyone can say they would do anything different), however I do wish to address something regarding TMM.

Should TMM ever go out of business (which I can guarantee you it will not as a result of whatever this guy has invented in his head) clients will not be left out in the cold.

For years we have maintained both our source code and a client list in escrow with our attorneys. Should we go out of business (which again, we won't) the source code would be distributed to all clients allowing them to continue forward.

Again, you should have no concern at all about us going out of business, especially in this case, but should that ever happen you are protected.
