LEESBURG, Va. - A man convicted in the nation's first felony prosecution for illegal spamming was sentenced to nine years in prison Friday, but the judge postponed the sentence while the case is appealed.

Loudoun County Circuit Judge Thomas Horne said that because the law targeting bulk e-mail distribution is new and raises constitutional questions, it was appropriate to defer the prison time until appeals courts rule.

Jeremy Jaynes was convicted in November for using false Internet addresses to send mass e-mail ads through an AOL server in Loudoun. Prosecutors said Jaynes sent more than 10,000 spam e-mails over three days in July 2003 from his Raleigh, N.C., area home, using the Internet to peddle sham products and services such as a "FedEx refund processor."

A jury had recommended the nine-year prison term.

Jaynes told the judge that regardless of how the appeal turns out, ?I can guarantee the court I will not be involved in the e-mail marketing business again.?

Lisa Hicks-Thomas, the prosecutor, said she was pleased with the ruling and confident that the law would be upheld on appeal.

?We?re satisfied that the court upheld what 12 citizens of Virginia determined was an appropriate sentence ? nine years in prison,? said Hicks-Thomas.

So for one burst of spam that was only 10,000 emails he gets 9 years? Im certainly against spam, but that is a bit ridiculous considering how much long term spammers send, I mean I have a mailbox with more than 17,000 spam emails, I think 9 years is way overboard.

He's stupid for just not settling with whoever was suing him. Theres really no defence in a spam case. You either own the domains/servers or you don't and no company will go after you unless they know for sure its you.

Federal is different than state, which is what I'm sure your numbers refer to because in Federal sentences you must serve 90% of the sentence.

The prosecution probably wasn't interested in settling it out of court. If this case is not overturned by appeal it'll go into case law and will precede other future cases.

As much as I hate spam myself, I fail to understand why it's illegal. Before I drop kicked my home phone I got three or four calls a night from telemarketers. And it's become difficult to figure out which mail from the post office is real compared to junk mail.

What the fuck are you talking about? Who the hell gets 3 months for raping a 2 year old? This myth that people get barely any time in prison for crimes is bullshit, especially at the Federal level. There are thousands if not hundreds of thousands of people serving 10 year or more sentences simply for the posession of small amounts of drugs. There are over 2 million people in state and federal prisons now, you would be surprised at the sentences that are handed down these days.

Tell that to my girlfriend I had at age 17, and my girlfriend I had at age 20.

Both were RAPED by their grandfathers at age 2. The two perverts got 2.5 and 3.5 months.
