Hi,
What nobody expected occurred? http://www.buldog.com and http://www.bulldog.com both domain names based on common names and very popular are incorrectly claimed to be used in bad faith by the Dutch trademark owner The Bulldog Amsterdam. In spite of the commitment from Network Solutions to block the web pages till the outcome of the Dutch court the two domains are unexpected transferred and blocked to the Dutch trademark owner The Bulldog Amsterdam. The claim is submitted after more than 4 years when I started the web pages. There are more than 800 other registered Bulldog trademarks in more than 20 countries. Lets go and register a big Adult Site name for a trade mark for underwear, or sportsteam than go to court 4 years after they have their site Take their site away Why bother paying eh? |

Ok, so you have been stuffed at WIPO:
http://arbiter.wipo.int/domains/deci...2004-0174.html I had a quick look and saw that the panelist (sole) seemed to use the Benelux trademark laws as you are both resident there, however that seems a bit strange considering it was a .com domain. I could understand it more if it was a .nl. BTW is your lawyer a specialist in internet law? |

Because you only live 30 minutes from The Bulldog Cafe in Amsterdam, it seems unlikely that you had no prior knowledge of their trademark when you registered the domain.
I'd say that fact made it much easier for them to prove that you registered the domain in bad faith. It would have been much more difficult if you were from Australia or somewhere far away and had never visited Amsterdam before. |

A trademark doesn't give ANYONE exclusivity over a domain or exclusivity to use the term in another business practice. You can have 1800 companies all using the name bulldog as long as they don't deal in the same sort of business. CLEARLY you don't with these guys. They probably were just pissed and jealous

I do agree that the word "BULLDOG" is very generic, and it's questionable whether it should have been given trademark protection.

I thank you all for the suggestions and shown support. But given the nature of this matter as well as the started legal actions from me against trademark owner The Bulldog I must respectfully decline from discussing in this matter. I trust you all understand.
