Hi,

What nobody expected occurred? http://www.buldog.com and http://www.bulldog.com both domain names based on common names and very popular are incorrectly claimed to be used in bad faith by the Dutch trademark owner The Bulldog Amsterdam. In spite of the commitment from Network Solutions to block the web pages till the outcome of the Dutch court the two domains are unexpected transferred and blocked to the Dutch trademark owner The Bulldog Amsterdam. The claim is submitted after more than 4 years when I started the web pages. There are more than 800 other registered Bulldog trademarks in more than 20 countries. All activities are meanwhile transferred to http://www.bulldoglist.com.

Yes, I'm aware that words like sex or men can't be trademarked, but he said that the people who got his domain have the Dutch trademark for Bull Dog, maybe Dutch trademark laws allow it

I had a quick look and saw that the panelist (sole) seemed to use the Benelux trademark laws as you are both resident there, however that seems a bit strange considering it was a .com domain. I could understand it more if it was a .nl.

BTW is your lawyer a specialist in internet law?

Because you only live 30 minutes from The Bulldog Cafe in Amsterdam, it seems unlikely that you had no prior knowledge of their trademark when you registered the domain.

I'd say that fact made it much easier for them to prove that you registered the domain in bad faith. It would have been much more difficult if you were from Australia or somewhere far away and had never visited Amsterdam before.

thats quite tenuous...he could have named it in honour of his dog that he had as a twelve year old.

This is a bad decision owing to the generic nature of the words in my albeit not worth much opinion.

A trademark doesn't give ANYONE exclusivity over a domain or exclusivity to use the term in another business practice. You can have 1800 companies all using the name bulldog as long as they don't deal in the same sort of business. CLEARLY you don't with these guys. They probably were just pissed and jealous

This is so total BS. . . Too bad it can't be overturned . . . . Or can it. I'd suggest you call John Berryhill. . . .(Look his name up at any site dealing with domains. . . .he has many wins defending Ultsearch among others )

What nobody expected occurred? http://www.buldog.com and http://www.bulldog.com both domain names based on common names and very popular are incorrectly claimed to be used in bad faith by the Dutch trademark owner The Bulldog Amsterdam. In spite of the commitment from Network Solutions to block the web pages till the outcome of the Dutch court the two domains are unexpected transferred and blocked to the Dutch trademark owner The Bulldog Amsterdam. The claim is submitted after more than 4 years when I started the web pages. There are more than 800 other registered Bulldog trademarks in more than 20 countries. All activities are meanwhile transferred to http://www.bulldoglist.com.

Wow, thats harash. Make sure to fight this all the way to the end in court. "Bull dog" is way too generic to claim ownership of and take away your domains.
