What nobody expected occurred / buldog.com

Hi,

What nobody expected occurred? http://www.buldog.com and http://www.bulldog.com both domain names based on common names and very popular are incorrectly claimed to be used in bad faith by the Dutch trademark owner The Bulldog Amsterdam. In spite of the commitment from Network Solutions to block the web pages till the outcome of the Dutch court the two domains are unexpected transferred and blocked to the Dutch trademark owner The Bulldog Amsterdam. The claim is submitted after more than 4 years when I started the web pages. There are more than 800 other registered Bulldog trademarks in more than 20 countries. All activities are meanwhile transferred to http://www.bulldoglist.com.

Let me know if you have any questions. Webmasters can contact me by webmaster at bulldoglist.com

Thx,
Olof

Jakke PNG 08-24-2004 06:43 AM

strobi 08-24-2004 06:43 AM

OUCHHHHHHHhhh.... you took a big hit there! Reminds me to secure some trademarks!

Pornopat 08-24-2004 06:48 AM

Sorry to hear that dude.

GTS Mark 08-24-2004 06:50 AM

cayne 08-24-2004 06:51 AM

Damn, that sucks. I hate these trademark issues...

Fake Nick 08-24-2004 06:52 AM

thats just bullshit ! bulldog = generic no one should be allowed to enforce trademarks on that

it is not like they made the term up !

steffie 08-24-2004 06:55 AM

Here is some food for thought

Lets go and register a big Adult Site name for a trade mark for underwear, or sportsteam

than go to court 4 years after they have their site

Take their site away

Why bother paying eh?

NiteRain 08-24-2004 06:57 AM

Dude I feel for you, actually got kind of the same email, from realtor.org, but they wanted to know if I was accredited with them or not. Sucks.

Reak 08-24-2004 07:01 AM

Fuck that's bad man

Lee 08-24-2004 08:28 AM

Hmm you should look up the verdict on the WIPO case of polo.com and get your lawyer onto it.

brand0n 08-24-2004 08:32 AM

you should so be able to beat this. way 2 generic.

BRISK 08-24-2004 08:36 AM

So if someone has a trademark for that name in any country of the world, they can grab your domain from you?

Martin 08-24-2004 08:39 AM

Damn sorry to hear that.

no

think about that for a sec. you dont think men magazine owns a trade mark on men, but do you think KRL is about to give up his baby men.com ? what about sex, ofcourse someone has trademarked sex by now, but im sure sex.com isnt about to hand over that jem.

Mike AI 08-24-2004 08:41 AM

Sounds like you got screwed. Might want to invest in a better attorney.

Yes, I'm aware that words like sex or men can't be trademarked, but he said that the people who got his domain have the Dutch trademark for Bull Dog, maybe Dutch trademark laws allow it

BRISK 08-24-2004 08:44 AM

Olof, are you Dutch

Lee 08-24-2004 08:59 AM

Ok, so you have been stuffed at WIPO:

http://arbiter.wipo.int/domains/deci...2004-0174.html

I had a quick look and saw that the panelist (sole) seemed to use the Benelux trademark laws as you are both resident there, however that seems a bit strange considering it was a .com domain. I could understand it more if it was a .nl.

BTW is your lawyer a specialist in internet law?

This part is what might have really nailed you. I wonder if you weren't domiciled in the Netherlands, if they would have been able to take this domain from you? hmmmm

JamesK2 08-24-2004 09:11 AM

That sucks, man :(

fr33s3x 08-24-2004 09:13 AM

Isn't Bulldog some kind of coffeeshop in Amsterdam ?
I'm sorry to hear that man.. Take care

hmmmm

Snake Doctor 08-24-2004 09:25 AM

That's a bad beat Olof.
Something like this they could have at least given you 30 days notice or something so you could redirect all the traffic to your other domain.

I don't know anything about Dutch law but here in the U.S. we'd be suing someone's ass off

justsexxx 08-24-2004 09:26 AM

Hi,

Not aure if you have a good attorney yet, is not, I can recommend you http://www.solv.nl/

We have great experience with them, and so had dialxs, kazaa, and some other p2p networks.

They also have patent/trademarks specialists there.

Because you only live 30 minutes from The Bulldog Cafe in Amsterdam, it seems unlikely that you had no prior knowledge of their trademark when you registered the domain.

I'd say that fact made it much easier for them to prove that you registered the domain in bad faith. It would have been much more difficult if you were from Australia or somewhere far away and had never visited Amsterdam before.

thats quite tenuous...he could have named it in honour of his dog that he had as a twelve year old.

This is a bad decision owing to the generic nature of the words in my albeit not worth much opinion.

What if his dog's name was McDonald's or Coca-Cola? Would that make it ok to use a domain with those words in it?

Lee 08-24-2004 09:47 AM

Potentially, Mcdonalds yes, Coca Cola no.

Mcdonald is a common name of Scottish origin.

Coca Cola is a created name by a company.

Cola should be ok though....

Lee 08-24-2004 09:53 AM

But of course money talks and smaller fish get fucked.

pimpin 08-24-2004 09:58 AM

A trademark doesn't give ANYONE exclusivity over a domain or exclusivity to use the term in another business practice. You can have 1800 companies all using the name bulldog as long as they don't deal in the same sort of business. CLEARLY you don't with these guys. They probably were just pissed and jealous

This is so total BS. . . Too bad it can't be overturned . . . . Or can it. I'd suggest you call John Berryhill. . . .(Look his name up at any site dealing with domains. . . .he has many wins defending Ultsearch among others )
, Ari Golderger (www.esqwire.com) or David Dingeman (cyberights.com)

By the way I used to own thebulldog.com sold it to a company in NL . . . HMMMMM I think I got 2k

Roald 08-24-2004 10:02 AM

http://www.gofuckyourself.com/showth...t=buldog .com

Thats pretty fucked up man, hope this will work out for you.

BRISK 08-24-2004 10:04 AM

I do agree that the word "BULLDOG" is very generic, and it's questionable whether it should have been given trademark protection.

Basic_man 08-24-2004 10:07 AM

That suck hard time ! :(

Corona 08-24-2004 11:30 AM

That sucks big time.

Doctor Dre 08-24-2004 11:38 AM

WTF it's a generic name . They should never have won this ...

KCat 08-24-2004 02:17 PM

That's horrible. 4 years of hard work...I hope there's something you can do to get the decision reversed.

buldog 08-25-2004 12:56 AM

I thank you all for the suggestions and shown support. But given the nature of this matter as well as the started legal actions from me against trademark owner The Bulldog I must respectfully decline from discussing in this matter. I trust you all understand.

Thx,
Olof
