What is your legal reliance for that legal fact?

opflix 07-08-2010 07:11 PM

talk to an attorney or paralegal to lookup the precedent... good luck!

see my post above... if the issue affects you directly, contact an attorney to research the precedent. the bank cannot kick you out/take your house cuz you haven't paid it off. those who took the red pill know what i'm talking about, those who don't know should find someone who knows how the game is played and they'll help you. be easy!

Okay, just how close is your house to the bushes in question, and does your fire dept suck so much they could not get there in time to protect your home from a burning bush?
:1orglaugh

The bushes are right behind my fence...maybe 20' in length, The large ash is about 10 feet from the fence, stand about 30' and then there are a couple of Jacaranda trees 10' from fence in the back that stand about 30' that are dying and have small dried leaves....combined with the 3"+ weeds and dead grass in his backyard, it would make a good flash fire and who knows what it could lite on fire. His front yard is no better and the side of his garage faces part of my backyard area too.
Along my back fence I have timber bamboo, grapefruit, orange and lemon trees along with natida trees which could all catch fire given the right circumstance. I water heavy so it may not be a problem....just don't want to have to go through it ;)

I have no idea how good our fire fighters are....never had to experience them visiting, but I would say they are most likely good. How fast they could get here, who knows.

Alky 07-08-2010 07:24 PM

you can move in behind me... feel free to water my lawn.

That's why I don't do shit for anyone. You should go get a pump and drain your pool into their backyard.

He may be a little uptight, but it is his property for now. Why not just mind your own business and stop creating a problem?

That would cost me a fine. You have to dump in the sewer clean out or the city stops by.

I drained it in the gutter one year because I could not find the clean out in the yard and they had no problem citing me....250.00 fine.....:1orglaugh

That's more fucked up than the idiot calling the cops for watering the trees. IMO As some who had a house fire you have no clue how horrible it is. I don't think him calling the cop's was right but setting someone house on fire is way more fucked up don't you think? Glad you don't live ANY where near me, I'm shocked that you would suggest that.

There have been a couple of times we discussed just walking away because the value of our home has dropped tremendously, we have been in this home over 20 years, we love it and are going to stay.

I have done too many improvements to just get up and leave........

I don't know what your financial situation is, but you might want to consider picking up a few in the area. Easier to keep the area from going to shit if you own a good chunk of it. :)

But I still think that your rights trump their rights to be ignorant. They don't seem to care that them fucking the bank by letting the property go to shit is also them fucking you, a person who has been a decent neighbour for 20 years.

Rochard 07-09-2010 07:55 AM

Why don't you sue him for intentionally lowering the value of your house?

I've gone a few rounds with my neighbor. He doesn't own the home but was renting, and the day he moved in he cut down all of the bushes between our house (that was on his property) and extended the driveway all the way to the property line so he can house his fleet of trucks for his landscaping business. Oh fuck no. I filed complaints with the HOA and then with the city, and he had to remove it. He was pissed.

Since then it's been nothing but both of us trying to piss each other off. I don't have a mean bone in my body; I find it funny really.

I won the last round. His house was raided by the police, and nine of ten people were taken away in handcuffs - and deported. Turns out that his entire staff for his illegal business were all here illegally. This includes the mother of his little baby.

Since then, the house is pretty much empty, only one truck, and only one person. A lot nicer this way.

I am not the suing type unless it is really necessary and it would be kind of hard to sue someone that doesn't have any money.....or maybe he does. For all the hassle, it just seems like it is not worth it. They will be moving soon......

I don't believe anyone is telling him what to do. It is a home owners responsibility to keep the property up and that is one thing he has not done. I wasn't the one who called the police and my position was to help keep the trees shrubs alive AND to try and curb any chance of a fire burning down my investment or other neighbors investments.

If they want to live with absolutely no rules or responsibility then they should buy a farm. I don't like being told what to do either, but when you live in the city, there are responsibilities and rules to follow. You would think neighbors would use some common sense and want to preserve the property value.

Actually, he always had the gate open if I ever want to pick my grapefruit or trim the trees between our property, but now there is no need for the gate because the entire block wall that runs from the side of his house to mu property fell over. :1orglaugh

He has always been a pretty cool guy, I think losing his home has taken it's toll and I just happened to be there during a bad moment. Heck, he has seen me watering before, waved and never said a thing...yesterday was a different story ;)
